8.12.010 Purpose and authority.

Under the authority of the State Constitution and other applicable law, and for the purpose of protecting the health and welfare of its citizens, this chapter is enacted to establish that certain acts constitute offense against the health and welfare of its citizens, and to establish penalties for such offenses. (Ord. 192 § 1, 1982).

8.12.020 Chemical pesticides and herbicides prohibited.

Because we consider the use of chemical pesticides and chemical herbicides to be a hazard to the health of our citizens, and therefore a public nuisance, the commercial use of these substances in the town shall be illegal from this time on. (Ord. 226 (part), 1986: Ord. 192 § 2, 1982).

8.12.030 Enforcement.

This chapter shall be enforced by the town mayor, town marshal or his deputy. (Ord. 192 § 4, 1982).

8.12.040 Penalty.

Any persons, corporations, businesses, governmental agencies or units of government violating this chapter or authorizing the violation of this chapter shall upon conviction thereof be fined five hundred dollars ($500.00) and costs of prosecutions. (Ord. 192 § 3, 1982).
