GOLF CART ZONE

10.16.010 Definitions.
(A) “Golf cart” means an electric-powered four (4) wheeled vehicle originally designed and manufactured for operation on a golf course for sporting purposes and has a speed attainable in one (1) mile of not more than twenty (20) miles per hour. A golf cart is not a nonhighway vehicle or off-road vehicle as defined in RCW 46.04.365.
(B) “Golf cart zone” means those streets, avenues, and alleys within the town of Index on which the operation of golf carts is permitted when in compliance with the provisions of RCW 46.08.175. (Ord. 497 § 1, 2022).
10.16.020 Golf cart zone established.
A golf cart zone is established by this chapter on streets, avenues, and alleys within the town of Index, and having speed limits of twenty-five (25) miles an hour or less, as follows:
(A) Avenue A between the east and west city limits.
(B) Index Avenue from 2nd Street to the gate approximately two hundred (200) feet east of 7th Street.
(C) 2nd, 6th, and 7th Streets between Avenue A and Index Avenue.
(D) 5th Street between Avenue B and the south city limits at the Wes Smith Bridge.
(E) 4th Street between Index Avenue and the alley to the south.
(F) The Crescent between Avenue A and Index Avenue.
(G) 8th Street between Avenue A and the alley to the north.
(H) 9th Street between Avenue A and the alley to the north.
(I) The alley, partially named Alley Way, lying between Index Avenue and Avenue A and running from 8th Street to 5th Street and from the Crescent to 4th Street. (Ord. 497 § 2, 2022).
10.16.030 Exclusions.
The following are excluded from the golf cart zone:
(A) All street, avenue, and alley rights-of-way not formally developed and maintained for vehicular traffic by the town and/or not specifically designated above.
(B) Sidewalks.
(C) The Crescent Trail west of the BNSF crossing in its entirety. (Ord. 497 § 3, 2022).
10.16.040 Golf cart use permitted.
The operation of golf carts within the designated golf cart zone is permitted subject to the following regulations:
(A) Every person operating a golf cart as authorized under this section is granted all rights and is subject to all duties applicable to the driver of a vehicle under Chapter 46.61 RCW (Rules of the Road).
(B) Every person operating a golf cart as authorized under this section must be at least sixteen (16) years of age and must have completed a driver education course or have previous experience driving as a licensed driver.
(C) A person who has a revoked license under RCW 46.20.285 may not operate a golf cart as authorized under this section.
(D) Golf carts shall not be operated within the designated golf cart zone between one-half (1/2) hour after sunset and one-half (1/2) hour before sunrise unless in compliance with Chapter 46.37 RCW regarding vehicle lighting. (Ord. 497 § 4, 2022).
10.16.050 Violation – Penalty.
Upon a determination that a violation of this chapter has occurred, law enforcement officers may issue a written warning to any person found in violation. (Ord. 497 § 5, 2022).
