NONCONFORMING USES

17.48.010 Continuance.

Nonconforming uses may be continued if:

(A) The use was lawful at the time it was established;

(B) The use has not been discontinued or the structures and/or lot housing the use has not been vacated for a period of twelve (12) consecutive months since the nonconformity was established; and

(C) The use has not been enlarged in scope or size. (Ord. 370 § 9 (part), 2004).

17.48.020 Nonconforming structures.

A non-conforming structure may be continued, altered, or enlarged if:

(A) Alterations to the structure do not increase the nonconformity;

(B) Alterations are necessary to meet local or state requirements;

(C) Alterations meet the existing requirements of the zone in which the structure is located. (Ord. 370 § 9 (part), 2004).

17.48.030 Restoration of damage.

A nonconforming structure may be restored if damaged by fire or other disaster in the same location and dimensions as existed before the damage occurred if restoration begins within one (1) year of the date the damage occurred. (Ord. 370 § 9 (part), 2004).

17.48.040 Nonconforming lots – Continuance.

A nonconforming lot may be continued if:

(A) The lot was a lawfully established lot at the time the nonconformity was created;

(B) All regulated uses of the nonconforming lot comply with all other provisions of this title. (Ord. 370 § 9 (part), 2004).
