The violation or failure to comply with any of the provisions of this chapter is deemed a civil violation subject to enforcement and penalties pursuant to Chapter 8.45 IMC. If an obstruction of the sanitary sewer collection system occurs that causes a sanitary sewer backup and/or overflow and such overflow can be attributed in part or in whole to an accumulation of fats, oil and grease in the sanitary sewer main line, the governing agency will take appropriate enforcement actions against the generator or contributor of such fats, oil and grease. In addition, those responsible for generating or contributing to unlawful discharge of fats, oil and grease to the sanitary sewer system must take immediate steps to bring the grease interceptor or other grease removal device into compliance, plus any additional actions necessary to bring the facility into compliance with this chapter.
