2.28.010 Fire department officers given police powers.

The chief, assistant chief and all captains and lieutenants of the fire department are given the powers of police officers at fires and during the progress thereof, with authority to keep order, prevent interference with the work of the department, and prevent violations of law. (Prior code § 3.16.010)

2.28.020 Fire department personnel—Duties.

Whenever the chief, assistant chief, or any captain or lieutenant of the fire department shall discover any fire which he shall deem to be dangerous but not of sufficient extent to require a general alarm, it shall be his duty, and he is authorized to extinguish said fire, or require that it be extinguished by the person or persons having same in charge. 2.28.030 Established—Membership.

There is created and established for the city a volunteer fire department, the membership of which shall be limited to not exceed twenty-five firefighters for each 1,000 population or fraction thereof of the city; provided, that in no case shall the membership be limited to less than fifteen firefighters. (Prior code § 3.18.010)

2.28.040 Administration—Powers and duties.

The volunteer fire department and the members thereof, shall function under the immediate direction of the fire chief or in his absence, the senior officer on duty. The members shall have all the powers and authority and shall be subject to all the duties of members of the regularly constituted fire department and shall be subject to the rules and regulations governing the fire department; provided, that membership in the volunteer fire department shall not constitute membership in the regularly constituted fire department nor shall any volunteer firefighter be entitled to any right or privilege of compensation, pension, civil service or other emolument attaching to membership in the regularly constituted fire department. 2.28.050 Death or disability protection.

Every member of the volunteer fire department shall be enrolled under the relief and compensation provisions of RCW Chapter 41.24 for the purpose of providing protection for such members and their families from death or disability arising in the performance of their duties as firefighters. 2.28.060 Retirement option—Eligibility.

Every member of the volunteer fire department shall have the option to avail himself of the retirement provisions of RCW Chapter 41.24, provided, such members shall successfully serve a probationary period of twelve months prior to being permitted to enroll. (Prior code § 3.18.040)

2.28.070 Retirement option—Payment collection.

The finance director of the city shall collect from the volunteers who elect to avail themselves of the retirement provisions mentioned in Section 2.28.060, the sums required by RCW 41.24.030(3) as it now exists or is hereafter amended, and remit those sums together with all other fees required by RCW 41.24.030 and 41.24.031 to the volunteer firemen's relief and pension fund in the state treasury on or before March 1st of each year. 2.28.080 Board of trustees—Composition—Meetings.

The board of trustees as created and established by RCW 41.24.060 for the administration of RCW Chapter 41.24 is recognized as consisting of the mayor, finance director, one councilmember other than the mayor, the chief of the regularly constituted fire department, and one member of the volunteer fire department to be elected by the volunteers for one year and annually thereafter. The board shall have a regular meeting at 7:00 p.m. on the first Tuesday of each month, provided, there is business to be transacted. (Prior code § 3.18.060)
