5.10.010 License required.

It is unlawful for any person to engage in the business of heavy manufacturing without first obtaining a business license from the City. If more than one business is conducted on a single premises, a separate license shall be required for each separate business conducted, operated, engaged in or practiced. [Ord. 15-0402 § 1 (Att. 5.10.020 Definitions.

For purposes of this chapter, the following terms shall have the following meanings:

A. “Business” means any commercial enterprise or activity conducted by any person or persons on any premises in the City.

B. “Heavy manufacturing” means an establishment engaged in the mechanical, physical, or chemical transformation of materials, substances, or components into new products that is likely to generate levels of truck traffic, noise, pollution, vibration, dust, fumes, odors, radiation, poisons, pesticides, or other hazardous materials, fire or explosion hazards, or other undesirable conditions that would be injurious to health or offensive to the senses, or would be an obstruction to the free use of surrounding property and essentially interfere with the comfortable enjoyment of life and property. Heavy raw materials may require significant outdoor storage. Examples include concrete manufacture, asphalt batch plants, mass production of commercial or recreational vehicles or large machinery, production of industrial organic and inorganic chemicals, animal slaughtering, and refining, extruding, rolling, or drawing of ferrous or nonferrous metals.

C. “Person” means any individual, receiver, assignee, trustee in bankruptcy, trust, estate, firm, co-partnership, joint venture, club, company, joint stock company, business trust, corporation, association, canvasser, peddler, solicitor, society, or any group of individuals acting as a unit, whether mutual cooperative, fraternal, nonprofit or otherwise, and includes the United States or any instrumentality thereof.

D. “Premises” means all lands, structures and places, and also any personal property which is either affixed to or is otherwise used in connection with any such business conducted on such premises. [Ord. 15-0402 § 1 (Att. A).]

5.10.030 Compliance with law.

The heavy manufacturing business shall comply with all applicable provisions of this code and City ordinances, which shall be enforced pursuant to the enforcement and penalty provisions of this title. [Ord. 15-0402 § 1 (Att. A).]
