10.10.010 Parking prohibited.

The parking of automobiles or other vehicles within the city limits of La Center between the hours of 8:00 a.m. and 6:00 p.m. on all days excepting Sundays and legal holidays observed by the city of La Center is fixed and restricted to a 30-minute time limit on the following streets and at the following locations:

On the north side of 4th Street, between Aspen Street and Birch Street. [Ord. 2009-05 §§ 1, 2, 2009.]

10.10.020 Notice of infraction.

(1) The parking prohibitions and restrictions provided in this chapter are designated traffic infractions. A notice of traffic infraction for violations of this chapter shall be given in accordance with the MTO and/or applicable court rule.

(2) Whenever parking time is limited or prohibited on designated streets, it shall be the duty of the public works director to erect appropriate signs giving notice thereof, and no such regulations shall be effective unless said signs are erected and in place at the time of the alleged offense. 10.10.030 Collection of fees.

Unless otherwise provided by ordinance, statute or court rule, the finance director/city clerk is authorized and directed to collect all fines or forfeitures collected or upon the forfeiture of bail of any person charged with a violation of this chapter which shall be paid into the city’s general fund. 10.10.040 Violation – Penalty.

(1) Penalties for violation of this chapter shall be $15.00 for each violation if paid within 15 days, and $25.00 for each violation if paid after 15 days.

(2) There shall be a penalty of $50.00 for failure to respond to a notice of traffic infraction issued under this chapter.

(3) Failure to make payments as specified under this chapter within a 15-day period shall render the owner or operator of the vehicle subject to other monetary and nonmonetary penalties provided by law including the nonrenewal of the violator’s motor vehicle license under the provisions of RCW 46.20.270 and 46.63.070, and applicable court rules. 10.10.050 Truck parking prohibited in residential areas.

(1) Except where specifically allowed pursuant to an adopted neighborhood parking plan and except for commercial vehicles while actually engaged in providing a service to a property, no person shall park or leave standing on a public right-of-way in any residential area of the city, either individually or in combination, any of the following:

(a) A truck with a gross vehicle weight capacity in excess of 9,000 pounds;

(b) A commercial tractor truck; or

(c) A commercial trailer.

(2) For purposes of this regulation, the following definitions shall apply:

(a) “Residential area” means any residentially zoned area that abuts a public right-of-way on one or both sides.

(b) “Trailer” means any vehicle that is not self-propelled, designed for carrying people or property in its own structure, to be drawn or pulled by a self-propelled vehicle.

(c) “Truck” means a motor vehicle designed primarily for the transportation of goods or property or the towing of a trailer.

(3) The operator and the licensed owner of any vehicle found to be in violation of this section shall be jointly and severally responsible for compliance with the provisions of this section. The operator and licensed owner of the vehicle, jointly and severally, shall be presumed to be in control of the vehicle, responsible for any violation of this section, and subject to citation for violations. Violations of this section shall be subject to citation under Chapter 2.15 LCMC, and any person determined to have violated this section shall be guilty of a civil infraction.
