15.05.010 Title.

The title of this chapter shall be the “La Center building code and specialty codes.” [Ord. 2013-05 § 1 (Exh. A), 2013; Ord. 2010-05 § 1 (Exh. 1), 2010; Ord. 2007-09 § 1, 2007; Ord. 2004-4 § 2, 2004.]

15.05.020 Purpose.

The purpose of this chapter is intended to designate a comprehensive building code regulating all building practices and standards prescribed herein. [Ord. 2013-05 § 1 (Exh. A), 2013; Ord. 2010-05 § 1 (Exh. 1), 2010; Ord. 2007-09 § 1, 2007; Ord. 2004-4 § 2, 2004.]

15.05.030 Adoption by reference of the building code and specialty codes as the La Center building code.

The following building and building-related codes, as currently adopted or as may be adopted in future enactments by the state of Washington pursuant to RCW 19.27.031, together with all adopted state amendments, and subject to the specific additions, deletions, and modifications set forth herein, shall be known as the “La Center Building and Specialty Codes”:

(1) International Building Code (IBC), 2018 Edition, as published by the International Code Council (ICC), and IBC Appendices B, E, H and J, and Chapter 51-50 WAC are hereby adopted with the following local amendments:

(a) Section 101.1. Substitute “La Center” for “[name of jurisdiction].”

(b) Section 101.4.3. Replace “International” with “Uniform”; delete the last sentence.

(c) Section 101.4.6. Replace “International Energy Conservation Code” and insert “Washington State Energy Code.”

(d) Section 105.2, #2. Strike “7'” and insert “6'.”

(e) Section 105.2, #6. Add the words “uncovered patios and decks” before the word “sidewalks.”

(f) Section 109.2. Add to the end of the sentence “by fee resolution.”

(g) Section 109.3 (Building Permit Valuations). Add a new sentence before the last sentence as follows:

Valuations may be determined by using Building Valuation Data as published annually by the IBC.

(h) Add a new paragraph to Section 109.3 (Plan Review Fee) to read:

A plan review fee shall be charged for plan reviews. Fees shall be set by the building official not to exceed sixty five percent (65%) of the building permit fee.

(i) Add a new table to Chapter 16 regarding commercial structural design information as follows:

 

Commercial Structural Design Information

This information only applies to structures not conforming to the prescriptive criteria set forth in the currently adopted International Building Code (IBC).

All other loading shear, bearing, and lateral conditions shall be per the International Building Code, with Washington state amendments and La Center Municipal Code.

All commercial occupancies are required to be designed by a Washington State Professional Licensed Architect and/or Engineer if the building is 4,000 sq feet or greater.

Wind speeds are now coordinated with Risk Categories for structures, per 2018 IBC and ASCE 7-16:

The seismic map link will provide the necessary calculation data including SS, SMS, S1, SM1, SD1, SDS, and the MCE Response Spectrum.

VULT = Ultimate design wind speed

Unless determined by Geotechnical Report, standard soil class definition is the default Site Class D - Stiff Soil.

Refer to IBC Section 1609 or ASCE 7-16 for detailed information.

The Risk Category for seismic design falls under I, II, or III. For essential structures, such as hospitals, the risk category is IV.

(j) Appendix J, Section J102.1 (Definitions). Add the following:

CIVIL ENGINEER. A professional engineer registered in the state to practice in the field of civil works.

CIVIL ENGINEERING. The application of the knowledge of the forces of nature, principles of mechanics and the properties of materials to the evaluation, design and construction of civil works.

EARTH MATERIAL. Any rock, natural soil or fill or any combination thereof.

ENGINEERING GEOLOGIST. A geologist experienced and knowledgeable in engineering geology and registered in the State of Washington.

ENGINEERING GEOLOGY. The application of geologic knowledge and principles in the investigation and evaluation of naturally occurring rock and soil for use in the design of civil works.

GEOTECHNICAL ENGINEER. See “soils engineer.”

PROFESSIONAL INSPECTION. The inspection required by this code to be performed by the civil engineer, soils engineer or engineering geologist. Such inspections include that performed by persons supervised by such engineers or geologists and shall be sufficient to form an opinion relating to the conduct of the work.

SOILS ENGINEER (GEOTECHNICAL ENGINEER). An engineer experienced and knowledgeable in the practice of soils engineering (geotechnical engineering).

SOILS ENGINEERING (GEOTECHNICAL ENGINEERING). The application of the principles of soils mechanics in the investigation, evaluation and design of civil works involving the use of earth materials and the inspection or testing of the construction thereof.

(k) Appendix J, Section J103.2 (Exemptions). Add the following two exemptions:

8. An excavation that (1) is less than 2-feet (610 mm) in depth or (2) does not create a cut slope greater than 5-feet (1,524 mm) in height and steeper than 1 unit vertical in 1-1/2 units horizontal (66.7% slope).

9. A fill less than 1-foot (305 mm) in depth and placed on natural terrain with a slope flatter than 1 unit vertical in 5 units horizontal (20% slope), or less than 3-feet (914 mm) in depth, not intended to support structures that does not exceed 50 cubic yards (38.3 m3) on any one lot and does not obstruct a drainage course.

(l) Appendix J, Section J104.1. Strike period and add: “on the excavation and grading supplemental application and provide other information as requested.”

(m) Appendix J, add Section J104.5 (Grading designation).

Grading equal to or more than 5,000 cubic yards (3,825 m3) shall be performed in accordance with the approved grading plan prepared by a civil engineer, and shall be designated as “engineered grading.” Grading involving less than 5,000 cubic yards (3,825 m3) shall be designated “regular grading” unless the permittee chooses to have the grading performed as engineered grading, or the building official determines that special conditions or unusual hazards exist, in which case, grading shall conform to the requirements for engineered grading.

(n) Appendix J, add Section J104.6 (Engineered grading requirements). Add:

Application for a grading permit shall be accompanied by two sets of plans and specifications, and supporting data consisting of a soils engineering report and engineering geology report. The plans and specifications shall be prepared and signed by an individual licensed by the state to prepare such plans or specifications when required by the Building Official.

i. Specifications shall contain information covering construction and material requirements.

ii. Plans shall be drawn to scale upon substantial paper and shall be of sufficient clarity to indicate the nature and extend of the work proposed and show in detail that they will conform to the provisions of this code and all relevant laws, ordinances, rules and regulations. The first sheet of each set of plans shall give location of the work, the name and address of the owner, and the person by whom they were prepared.

iii. The plans shall include the following information:

a. General vicinity of the proposed site.

b. Property limits and accurate contours of existing ground and details of terrain and area drainage.

c. Limiting dimensions, elevations or finish contours to be achieved by the grading, and proposed drainage channels and related construction.

d. Detailed plans of all surface and subsurface drainage devices, walls, cribbing, dams and other protective devices to be constructed with, or as a part of, the proposed work, together with a map showing the drainage area and the estimated runoff of the area served by any drains.

e. Location of any buildings or structures on the property where the work is to be performed and the location of any buildings or structures on land of adjacent owners that are within 15-feet (4,572 mm) of property or that may be affected by the proposed grading operations.

f. Recommendations included in the soils engineering report and the engineering geology report shall be incorporated in the grading plans or specifications. When approved by the Building Official, specific recommendations contained in the soils engineering report and the engineering geology report which are applicable to grading, may be included by reference.

g. The dates of the soils engineering and engineering geology reports together with the names, addresses and phone numbers of the firms or individuals who prepare the reports.

(o) Appendix J, add Section J104.7 (Engineering Geology Report).

The engineering geology report required by J104.3 shall include an adequate description of the geology of the site, conclusions and recommendations regarding the effect of geologic conditions on the proposed development, and opinion on the adequacy for the intended use of sites to be developed by the proposed grading, as affected by geologic factors.

(p) Appendix J, Section J112 (Grading and Erosion Control Fees) shall be adopted and incorporated into the La Center Building and Specialty Codes:

Section J112 Grading and Excavation Fees:

J112.1 (General). Fees for plan reviews and permits for grading or required excavation shall be assessed in accordance with the provisions of this section or shall be as set forth in the fee schedule adopted by the jurisdiction.

J112.2 (Plan review fees). When a plan or other data are required to be submitted, a plan review fee shall be paid at the time of submitting plans and specifications for review. Separate plan review fees shall apply to retaining walls or major drainage structures as required elsewhere in this code. For excavation and fill on the same site, the fee shall be based on the volume of excavation or fill, whichever is greater.

(q) Appendix J, add Section J113 (Bonds).

The Building Official and City Engineer may require bonds in such form and amounts as may be deemed necessary to ensure that the work, if not completed in accordance with the approved plans and specifications, will be corrected to eliminate hazardous conditions. In lieu of a surety bond the applicant may file a cash bond or instrument of credit with the Building Official in an amount equal to that which would be required in the surety bond.

(2) International Residential Code (IRC), 2018 Edition, as published by the International Code Council, and IRC Appendices F, Q and U, Chapter 51-51 WAC, exempting IRC Chapter 11 and Chapters 25 through 43, are hereby adopted with the following amendments:

(a) R101.1. Insert “City of La Center” for [name of jurisdiction].

(b) R105.2 (Permits, Building). Amend subsection 1, strike “200” and insert “120.”

(c) Amend subsection 2. Strike 7' and insert 6' (no change).

(d) R105.2 (Permits, Building). Strike out subsection 10 and insert the following: “Decks, or platforms with no roof or cover not over 30 inches above finish grade.”

(e) R105.2 (Permits, Building). Add subsection 11 to read:

Re-roofing of one and two family dwellings or buildings accessory to these dwellings may be exempt for up to a maximum of a second overlay per Section R908.

(f) R105.2 Strike Plumbing Sections 1 and 2 and Electrical Sections 1 through 5.

(g) Table R301.2(a) is hereby amended to read:

(3) International Fire Code (IFC), 2018 Edition, as published by the International Code Council with Appendices B, C, D, E, F, and G, and amendments Chapter 51-54A WAC as adopted by Washington, is hereby adopted with the following amendments:

(a) Chapter 1 Amendments.

(i) Section 101.1. Insert “City of La Center” for [name of jurisdiction].

(ii) Add Section 104.12 with the following:

City Fire Official shall be the Building Official. The Fire Marshal is the designee of the City of La Center by contract. The 'Chief' is the Clark County Fire and Rescue Battalion Commander. The Chief will assist the City in matters of fire protection and related equipment. Fire code enforcement duties are delegated by the Building/Fire Official per agreements with the others.

(iii) Section 105.1.1. Replace the word “fire” with “building,” and add the following sentences:

The Building Official will refer applications to the fire marshal/designee. Any approved proposal to install new fire code related systems or to modify or add to any regulated existing systems shall be referred to the City for processing and delegated to the contracted entities for review, permitting, inspection and approval.

(b) General Provisions.

(i) Construction Plan Review. Plans shall be submitted to and approved by the building official for all new commercial building and residential construction or land development prior to the issuance of any approvals or permits or commencement of development or construction. Further review by the fire marshal will be at the discretion of the building official. During development review, the city planner shall refer the application to the appropriate review authority (Clark County fire and rescue).

(ii) Fire Investigations. The fire marshal is authorized to investigate the origin, cause and circumstances of fires occurring within the city of La Center involving loss of life or injury to person or destruction or damage to property. If it appears to the fire marshal that such fire is of suspicious or incendiary nature, the fire marshal shall immediately take charge of all physical evidence relating to the cause of the fire and notify the La Center public works and police departments and Washington State Patrol. The fire marshal is authorized to investigate the origin, cause, and circumstances of unauthorized releases of hazardous materials. The La Center police department is herein authorized to assist the fire marshal.

(iii) Fire Lanes. The fire marshal is empowered to designate fire lanes in all new construction. The La Center police department is empowered to enforce no parking in marked fire lanes. A fine of $101.00 is authorized for each violation, if the fire lane is completely blocked to the passage of fire apparatus by an unlawfully parked vehicle. The La Center police department is additionally empowered to impound, pursuant to RCW 46.55.085, the blocking vehicle at the owner’s expense. Unmarked areas within 15 feet of a fire hydrant or fire department connection (FDC) are automatically considered a fire lane.

(iv) Fire hydrants type and spacing shall be reviewed by the contracted fire marshal.

(A) Spacing (Other Than R-3). Fire hydrants serving buildings or portions of buildings or premises, facilities or uses other than one- and two-family dwellings, Group M occupancies shall have a maximum lateral spacing not to exceed 300 feet as a condition of building permit approval, site plan review or change in use. Fire hydrants more than 15 feet from an approved access road or fire lane that serves the building in question shall not be counted in any calculation of fire hydrant spacing.

(B) Spacing (R-3). Fire hydrants serving one- or two-family dwellings shall have a maximum lateral spacing of 500 feet with no building in excess of 400 feet from a fire hydrant as a condition of approval for residential subdivision or short subdivision.

(C) Fire Hydrant Accessibility. All fire hydrants, public or private, must remain accessible for fire department use at all times. A three-foot area completely free of obstructions is required around all fire hydrants. On-site fire hydrants and water supplies on adjacent property shall not be considered available, unless accessible by fire apparatus on approved access road. Fire hydrants more than 15 feet from an approved road or fire lane shall not be counted in any calculation of fire hydrant spacing.

(D) Fire Hydrant Availability. Fire hydrants located on the opposite side of roadways shall not be considered in the fire hydrant placement requirements unless specifically approved by the fire marshal.

(v) Fire Department Connections. Unless exempted by the fire marshal, a fire hydrant shall be located within 40 feet of all required and approved fire department connections. The fire department connection (FDC) shall be located remote from the building and outside of the building collapse zone. This area should be clearly marked “Fire Lane No Parking.” No building access road can be blocked by fire hose(s) while making the fire department connection.

(c) Fire Sprinklers.

(i) General. An automatic sprinkler system shall be installed and maintained in operable condition in occupancies, structures, and locations as set forth in this chapter.

(ii) Definitions.

(A) “Addition” is an extension in floor area or height of a building or structure.

(B) “Automatic fire sprinkler system,” as used herein, is defined as an integrated system of underground and/or overhead piping beginning at the connection to the primary water supply, whether public or private, that conveys water with or without other agents to dispersal openings or devices to extinguish, control, or contain fire or other products of combustion; said system complying in all respects with the requirements for such systems contained in appropriate standards issued by the National Fire Protection Association.

(iii) Sprinkler Systems, Where Required.

(A) In all buildings or structures when required by the code and all commercially zoned buildings containing a total floor area, above or below grade, exceeding 5,000 square feet.

(B) In occupancies with limited fire flow or access such as flag lots, substandard road widths, private bridges, private roads and roads of 12 percent grade or greater, as determined by the chief.

(C) In new industrial and/or commercial occupancy buildings shall have automatic sprinkler systems when the height of the building exceeds three stories above grade.

(4) Uniform Plumbing Code (UPC), 2018 Edition, as published by the International Association of Plumbing and Mechanical Officials, excepting Chapters 12 and 15, but including Appendices A, B and I, Chapter 51-56 WAC, are hereby adopted with the following amendments:

(a) 102.1. Delete entire section.

(b) 106.3 (Penalties). Strike the word “misdemeanor” and replace with the words “civil infraction” and strike the words “imprisonment, or both” and replace with the word “as” in the first sentence.

(c) 104.5 (Permit Fees). Add the words “by resolution” to the end of the sentence after the word “jurisdiction.”

(d) 104.3.2.1 (Plan Review Fees). Strike the second paragraph and replace with the following:

The plan review fees when appropriate and applicable for plumbing work requiring plans or other data shall be set by resolution.

(e) Table 104.5 (Additional Fees). Change after “plan review”; add “or additional review.”

(5) International Mechanical Code (IMC), 2018 Edition, with Appendices A and B, Chapter 51-52 WAC, the 2018 National Fuel Gas Code (NFPA 54), WAC 51-52-21000, the 2017 Liquefied Petroleum Gas Code (NFPA 58), as published by the National Fire Protection Association, along with the International Fuel Gas Code (IFGC), 2018 Edition, are adopted. Standards for liquefied petroleum gas installations shall be the 2017 Edition of NFPA 58 (Storage and Handling of Liquefied Petroleum Gases) and the 2015 Edition of ANSI Z233.1/NFPA 54 (National Fuel Gas Code).

(a) 101.1 (Title). Insert “The City of La Center” for the [name of jurisdiction].

(b) 108.3. Strike the phrase following “shall...request the legal counsel of the jurisdiction,” and replace the phrase after “proceeding... at law or in equity” with “under the La Center Municipal Code.”

(6) International Energy Conservation Code (IECC), 2018 Edition, Chapters 51-11C and 51-11R WAC. As adopted and amended, a.k.a. the Washington State Energy Code, 2018.

(7) International Property Maintenance Code, 2018 Edition. As adopted by the IBC.

(a) 101.1 (Title). Insert “The City of La Center” for the [name of jurisdiction].

(b) 103.5 (Fees). Add sentence as follows: “The permit and plan review fees are to be determined and adopted by this Jurisdiction by resolution.”

(c) 106.4 (Violation Penalties). Strike the first sentence and replace with:

Persons who shall violate a provision of this code or shall fail to comply with any of the requirements thereof shall be subject to penalties as prescribed by law.

(8) International Existing Building Code (IEBC), 2018 Edition.

(a) 101.1 (Title). Insert “The City of La Center” for the [name of jurisdiction]. [Ord. 2021-02 § 1 (Exh. A), 2021; Ord. 2018-04 § 2 (Exh. A), 2018.]

15.05.040 Contracts for services.

The city may authorize interlocal agreements or contracts for services as necessary to administer and enforce the La Center building and specialty codes. [Ord. 2013-05 § 1 (Exh. A), 2013; Ord. 2010-05 § 1 (Exh. 1), 2010; Ord. 2007-09 § 1, 2007; Ord. 2004-4 § 2, 2004.]

15.05.050 Building and development application fees.

The fees for building and development permits are as set forth in Table A below. The valuation to be utilized is as set forth in the most current edition of the International Code Council Building Valuation Data. Permit fees are collected prior to or at the time of the issuance of the permit. A permit shall not be valid until the fees prescribed have been paid, nor shall an amendment to a permit be released until the additional fee, if any, has been paid. The city may use the services of an outside professional consultant for plan review services; all invoices associated with the services of an outside professional consultant, including an administrative services charge, shall be paid prior to or at the time of permit issuance. All other fees, including but not limited to impact fees and system development charges, must also be paid prior to or at the time of permit issuance. In the event of any conflict between this section and LCMC 15.05.030, this section shall prevail.
