1.15.010 Purpose.

The provisions of this chapter establish general penalties for violations of the provisions of city ordinances or failing to comply with any mandatory requirement of any Langley city ordinances. (Ord. 926, 2009)

1.15.020 Infraction.

A. The noncriminal penalty of infraction is hereby established as a penalty for violation of certain ordinances of the city of Langley.

B. The penalty for an infraction shall be monetary only and the fine shall not exceed $1,000.

C. An individual who is served with a notice of infraction shall have the option of choosing either: (1) to pay the monetary penalty; (2) to request a hearing to explain the circumstances and to request mitigation; (3) to request a hearing to contest the infraction notice.

D. Failure to respond to an infraction notice or failure to appear at any court hearing which the individual requests will be deemed a misdemeanor punishable by a fine not to exceed $1,000 and/or imprisonment.

E. The burden of proof applicable to all infractions shall be “preponderance of the evidence.”

F. The Langley municipal court may accept the notice of infraction and any other written report of the officer made under oath in lieu of the officer’s personal appearance in making its determination of whether a violator committed an infraction. (Ord. 926, 2009)

1.15.030 Misdemeanor.

A. Any person violating any of the provisions or failing to comply with any of the mandatory requirements of any ordinance of the city of Langley is guilty of a misdemeanor. Except in cases where a different punishment is prescribed by any ordinance of the city of Langley, any person convicted of a misdemeanor shall be punished by a fine not to exceed $1,000, or by imprisonment not to exceed 90 days, or both such fine and imprisonment.

B. Each such person is guilty of a separate offense for each and every day during any portion of which any violation of any provision of the ordinance is committed, continued or permitted by any such person, and is punishable accordingly. (Ord. 926, 2009)
