10.12.010 General prohibitions.

No person shall stop, stand or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with the directions of a peace officer or traffic control device, in any of the following places:

A. On a sidewalk or planting strip;

B. In front of a public or private driveway or within five feet of the end of the curb radius leading thereto, except where official signs or markings designate a parking space near a driveway;

C. Within an intersection;

D. Within 15 feet of a fire hydrant;

E. On a crosswalk;

F. Within 30 feet upon the approach to a flashing beacon, stop sign or traffic control signal or sign located at the side of a roadway;

G. Alongside or opposite any street excavations or obstruction when such stopping, standing or parking would obstruct traffic;

H. On the roadway side of any vehicle stopped or parked at the edge or curb of a street (double parking);

I. At any place where official signs prohibit stopping;

J. On any street in such a manner as to block or interfere with the free use of the street or any alley or driveway. (Ord. 1010 § 1, 2015; Ord. 464, 1985)

10.12.020 Unlawfully moving another person’s vehicle.

No person shall move a vehicle into a prohibited area or away from a curb such a distance as is unlawful. (Ord. 464, 1985)

10.12.030 Parallel parking required – Exceptions.

No person shall stand or park a vehicle in a roadway other than parallel with the edge of the roadway, headed in the direction of traffic and with the curbside wheels of the vehicle within 12 inches of the edge of the roadway, except upon those streets which have been marked or signed for angle parking vehicles shall be parked at the angle to the curb indicated by such marks or signs. No vehicle shall be allowed to be backed against or parked at the curb or street line at any place in the city, except such commercial vehicles as are actually engaged in loading or unloading shall be continuous and shall be completed as rapidly as possible. In no event shall any commercial vehicle be so backed to the curb as to extend out into the street to a point nearer than eight feet from the center of the street. (Ord. 464, 1985)

10.12.040 Obstructing roadway prohibited – Exception.

No person shall stop, stand or park any vehicle upon a street in such a manner or under such conditions as to leave available less than 10 feet of the width of the roadway for free movement of vehicular traffic, except that a driver may stop temporarily during the actual loading or unloading of passengers or when necessary in obedience to traffic regulations or traffic signs or signals or directions of a peace officer. 10.12.050 Long-term parking restrictions.

A. It is unlawful to park a vehicle upon any street of the city’s business district for a period longer than 24 hours continuously. Residential street parking is limited to 72 hours continuously.

B. It is unlawful for any boat trailer, recreational vehicle or trailer to park on any street or right-of-way for a period longer than 24 hours. (Ord. 464, 1985)

10.12.060 Restricted parking zones.

A. Emergency Vehicles Only. No vehicle shall park in spaces posted or signed for police or emergency vehicle parking only, unless the vehicle is an emergency vehicle as defined in RCW 46.37.190.

B. State Disabled Parking Only.

1. Only vehicles which display a special license plate, card or decal issued by this or any other state shall be entitled to park in a parking space reserved for physically disabled persons pursuant to Chapter 70.92 RCW. A parking space for a physically disabled person shall be indicated by:

a. A painted white line, at least six inches in width on the improved surface delineating the perimeter of the parking space or stall; and

b. A vertical sign, between 48 and 60 inches above the ground, with the international symbol of access described under RCW 70.92.120 and the notice: “State Disabled Parking Permit Required.”

2. It is unlawful for any person to park a vehicle in a parking space provided on private property without charge, or on public property reserved for physically disabled persons, without a special license plate, card or decal.

3. If a person is charged with a violation, the person shall not be determined to have committed the infraction if the person produces in court or prior to the court appearance, the special license plate, card or decal required under this section, or demonstrates that the person was entitled to the special license plate, card or decal.

C. Service or Official Vehicles Only. When properly posted by official sign, no vehicle shall park in “Service Vehicle Only” zones unless the vehicle is a city or other government vehicle and/or a contracted service vendor.

D. Loading Zone. Loading zones as marked by official sign, or by yellow-painted curb or both, shall be used for the continuous loading or unloading of vehicles. The loading zone shall only be used as is necessary and the unloading or loading shall be completed as rapidly as possible.

E. No-Parking Zones. No parking shall be allowed in zones indicated with painted red curbing and/or official signs.

F. No Parking Anytime – Impound Zone. No parking shall be allowed in zones indicated with painted red curbing and/or official signs that state “No Parking – Impound Zone.” Parking in said areas shall be an infraction punishable by a fine of not less than $100.00 for the first offense. The second offense shall be punishable by a fine of not less than $200.00. Any offense after the second may be punishable by a fine up to but not to exceeding $500.00. 10.12.070 Regulated parking periods – Designated areas.

A. Fifteen-Minute and 30-Minute Parking. All 15-minute and 30-minute parking zones will be marked with yellow curb and posted with official signs which list the maximum time period allowed.

B. Four-Hour Parking. No person shall stop, stand or park a motor vehicle of any type between the hours of 8:00 a.m. and 6:00 p.m. for a period longer than four hours, within the area in the central business zone described as follows: First Street from the intersection at Second Street/Cascade Avenue to the west border of the central business zone, Anthes Avenue from First Street to Third Street, Second Street in the commercial area west of Anthes Avenue, Second Street east from Anthes Avenue to the intersection of First Street/Cascade Avenue. Exception: Residents and businesses that have no off-street parking available may apply for a free parking permit(s). Application shall be made to the police chief who shall review the application. Upon approval of the application by the police chief, he shall issue a permit that shall be displayed on the dash of the permitted vehicle any time the vehicle occupies a parking space described in this section.

C. Commercial Zone Regulated Parking. In addition to the areas designated in this section, specified areas of the city may be classified regulated parking areas, utilizing the restrictions specified in this section, upon order of the mayor and placement of the appropriate signage. 10.12.080 Temporary parking closures for special events.

A. The public works director shall have the authority to temporarily close streets to parking as necessary for repair, construction or the protection of citizens to hazards. All closures will be effected with proper warning signs and barricades to show the area closed.

B. The police department shall be notified of any closure and, if possible, a notice shall be placed in the city’s designated newspaper to notify citizens of the parking closure.

C. The police chief or his designate shall have the authority to close or modify city streets to parking due to special events, or traffic hazards or disasters. The modifications or closures will be effected by official signs and barricades that will list the modification or restriction for parking.

D. Violation of temporary restrictions shall carry the same penalty as violation of any other provisions of this chapter. (Ord. 741, 1997; Ord. 464, 1985)

10.12.090 Overnight parking in park and recreation areas prohibited – Penalty.

A. It is unlawful to park overnight any vehicle or other private property, including trailers, travel trailers, boat trailers, or other personal property in areas designated as, or used for, public park or recreation purposes within the limits of the city when marked with official signs prohibiting such parking.

B. Each night of overnight parking, in an area marked with official signs prohibiting such parking, shall constitute a separate offense under the terms of this section.

C. In areas where overnight parking is allowed, parking of any vehicle including travel trailers, boat trailers, or other personal property shall be limited to 72 hours within a seven-day period. Changing parking spaces or leaving the parking area temporarily shall not affect this limit. The seven-day period starts with the first day of parking. (Ord. 741, 1997; Ord. 282, 1985)

10.12.100 Violation – Authority to impound.

A. Any violation listed in this chapter can be grounds for impounding by the police department.

B. Impoundment of vehicle will occur primarily when the violating vehicle constitutes a traffic hazard, obstructs vehicle or pedestrian traffic, or is left in restricted or regulated parking zones. (Ord. 464, 1985)

10.12.110 Violation – Responsibility of registered owner.

Every person in whose name a vehicle is registered shall be responsible for any parking of such vehicle and for all offenses, other than moving violations, in violation of this chapter. It shall be no defense to such charges that the vehicle was illegally parked or used by another unless proof be shown that at such time the vehicle was stolen and was used without the consent of the registered (licensed) owner. This section shall not apply to registered owners transferring vehicle ownership who have complied with RCW 46.52.104 prior to the date of the violation. (Ord. 464, 1985)

10.12.120 Oversize vehicle reserved parking permits – Required.

A. Permits are required for the reservation of temporary oversize vehicle parking on city streets or rights-of-way.

B. Permits will not be issued if the desired use is a:

1. Commercial sales or advertising use.

2. Traffic or pedestrian hazard. Exceptions may be waived by the police chief if appropriate safety devices such as barricades are used.

3. Health, fire, or public nuisance hazard.

4. Continuing use. The permits are temporary and are not to be granted for more than five consecutive days. (Ord. 724, 1996; Ord. 464, 1985)

10.12.125 Insurance required.

When available, a certificate of liability insurance shall be submitted to the city prior to permit issuance. The city of Langley shall be named as additional insured. The minimum insurance coverage shall be determined administratively based on the value of the work and the risk involved. All applicants shall be required to sign a hold harmless agreement that is included in the application form. (Ord. 724, 1996)

10.12.130 Oversize vehicle reserved parking permit – Fee.

A fee, as set by council resolution, shall be charged for the oversized vehicle reserved parking permit and deposited into the city’s general fund. Renewal for five more consecutive days may occur only if considered necessary by the police chief or his duly authorized representative.

Renewal for each five-day period will require payment of another permit fee. If barricades are necessary to secure the desired parking space(s), a barricade rental fee, in addition to the permit fee, shall be charged. The amount of the rental fee shall be set by council resolution and any barricade rental fees received by the city shall be deposited into the street fund. (Ord. 724, 1996; Ord. 464, 1985)

10.12.140 Oversize vehicle reserved parking permit – Required information.

A. The permit will contain the dates of authorized use, names of permittee, phone number where permittee can be reached day and night and vehicle license number.

B. Inspection by the police chief or his duly authorized representative, requiring his/her signature, is required the first day of intended use. (Ord. 724, 1996; Ord. 464, 1985)

10.12.150 Oversize vehicle reserved parking permit – Display.

The approved permit will be required to be placed on the dash of the authorized vehicle. It must be clearly visible by traffic. (Ord. 724, 1996; Ord. 464, 1985)

10.12.160 Obstructing or tampering with enforcement.

It is unlawful for a person to erase chalk marks placed on tires of vehicles by enforcement officers of the city or to tamper with the enforcement process by removing parking violation notices from vehicles as posted by enforcement officers. (Ord. 464, 1985)

10.12.170 Violation – Infraction.

Violation of any provision of this chapter is an infraction. (Ord. 464, 1985)
