10.13.010 Purpose of provisions – Definitions.

Unregulated overnight parking of recreational vehicles on streets, vacant lots, open areas and private property in the city has the potential to create substantial health, safety, economic and quality of life problems. This chapter establishes standards, procedures and restrictions intended to control overnight parking of RVs and camping.

A. “Recreational vehicle (RV),” for the purpose of this chapter, is any motor home, vacation trailer, camping trailer, camper, conversion van, or makeshift vehicle capable of movement on a roadway, which will afford a degree of shelter for humans.

B. “Camping,” for the purpose of this chapter, is sleeping outdoors in the open, in a tent, in a motor vehicle, RV, or other similar temporary shelter. (Ord. 981 § 1, 2012)

10.13.020 Overnight parking of RVs prohibited.

The parking of recreational vehicles on public property, or public street, including any portion of a dedicated right-of-way within the city limits of Langley, for the purpose of occupancy, camping or sleeping between the hours of 10:00 p.m. and 6:00 a.m. is prohibited. (Ord. 981 § 1, 2012)

10.13.030 No outdoor camping permitted.

Outdoor camping within Langley’s public parks, rights-of-way, and other city-owned public property is not permitted except by prior approval of the city council, provided sanitary and garbage facilities must be available for groups of outdoor campers.

Exceptions.

A. The occupants of each single-family residence in the city or their guests, regardless of zoning district, may camp in no more than one recreational vehicle on private property for up to seven days without a permit issued by the city, and for an extended period not to exceed 30 days upon issuance of a temporary use permit by the city planning director.

1. The permit issued must be affixed to the recreational vehicle in such a manner that it is prominently displayed and visible, to the extent possible, from the public right-of-way.

2. Recreational vehicles meeting the requirements of this subsection may be parked in a front yard, need not be sight-screened and need not comply with accessory structure setback requirements for the effective period of the permit.

3. Each residence will be limited to one temporary use permit within any six-month period.

B. This chapter shall not pertain in any property upon which by local ordinance or special event permit approved by the council overnight camping within the city limits of Langley is allowed. In which case, the ordinance establishing such special area or areas shall have primary authority regarding this activity. (Ord. 981 § 1, 2012)

10.13.040 Violation – Penalties.

Violation of this chapter shall be punishable by a fine of not greater than $100.00 per day for each day the violation occurs. The city may also exercise civil remedies to enjoin any violation of this chapter and in the event the city is a prevailing party in such action the nonprevailing party shall be required to pay the city’s costs and reasonable attorney’s fees.
