18.12.010 Adopted – Districts established.

The city is divided into zoning districts as shown on the official zoning map which, together with all explanatory matter thereon, is adopted by reference and declared to be a part of this title. 18.12.015 District purpose statements.

Residential 6 District: This is a residential low-density district in which the principal use of land is for single-family dwellings, duplexes, and accessory dwellings, together with recreational, religious, and educational facilities required to serve the community. The regulations for this district are designed and intended to establish, maintain and protect the essential characteristics of the district, to develop and sustain a suitable environment for residents, and to prohibit almost all activities of a commercial nature and those which would tend to be inharmonious with or injurious to the preservation of a residential environment.

Residential 8 District: This is a residential low-density district in which the principal use of land is for single-family dwellings, duplexes, and accessory dwellings, together with recreational, religious, and educational facilities required to serve the community. The regulations for this district are designed and intended to establish, maintain and protect the essential characteristics of the district, to develop and sustain a suitable environment for residents, and to prohibit almost all activities of a commercial nature and those which would tend to be inharmonious with or injurious to the preservation of a residential environment.

Multifamily District: This is a medium-density residential district designed to accommodate multifamily uses, together with recreational, religious, and educational uses required to serve the community. This district is intended to provide for increased variety and range of cost for housing in Leavenworth. The multifamily district is also intended to serve as a buffer between commercial and single-family districts, and to provide incentive for renewal and redevelopment of older residential areas.

General Commercial District: The general commercial district classification is intended to be applied to areas suitable and desirable for wholesale and retail sales and services not properly a part of the central area.

Central Commercial District: The central commercial district is intended to provide an appropriately located area of concentrated retail stores, offices, and service establishments of limited nature serving the residents of the city and the surrounding area. Recognizing the established character and attractive scale of the central part of the Leavenworth business area, it is the further purpose of this district regulation to protect and enhance this area for the benefit of the city, businesses, property owner, and the general public.

Tourist Commercial District: The tourist commercial district classification is intended to be applied to areas suitable and desirable for motels, restaurants, service stations and similar uses to accommodate auto-oriented patrons. This district is suitable for residential uses.

Light Industrial District: The purpose of the light industrial district is to promote the development of clean, light manufacturing of goods and wares. In addition, the light industrial district can accommodate storage type facilities.

Recreation District: The recreation district is to promote both passive and active recreation. This district is suitable for such uses as wildlife refuge and sanctuaries, municipal parks, ball fields, playgrounds, and golf courses. This designation is not applicable to commercial amusement parks and other such activities. This designation may also be appropriate for institutions that utilize play fields and/or open space as part of their normal day-to-day operation or landscaping.

Recreation Public District: The recreation-public district is intended to be applied to publicly owned properties for public recreation and utility uses. This district is suitable for recreational and public uses, and commercial uses that are determined by the city’s legislative authority to be in the best interest of the community. 18.12.020 Certification.

The official zoning map shall be identified by the signature of the mayor, attested by the city clerk-treasurer, and bearing the seal of the city under the following words:

This is to certify that this is the official zoning map referred to in Section 1 of Ordinance No. ___ of the city of Leavenworth, Washington.

18.12.030 Change procedure.

Amendments to the zoning map shall be considered pursuant to LMC 21.35.030, Zoning map amendments. [Ord. 1596 § 1 (Att. A), 2019; Ord. 1503 § 1 (Att. A), 2015; Ord. 551 § 12.100, 1976; Ord. 531 § 1, 1973.]

18.12.040 Unauthorized change – Penalty.

No changes of any nature shall be made in the official zoning map or matter shown thereon except in conformity with the procedures set forth in this title. Any unauthorized change of whatever kind by any person or persons shall be considered a violation of this title and punishable as provided under Chapter 21.13 LMC. [Ord. 1596 § 1 (Att. 18.12.050 On file – Final authority.

18.12.060 Replacement – When – Certification.

In the event that the official zoning map becomes damaged, destroyed, lost or difficult to interpret because of the nature or the number of changes and additions, the city council may, by resolution, adopt a new official zoning map which shall supersede the prior official zoning map. The new official zoning map may correct drafting or other errors or omissions in the prior official zoning map, but no such correction shall have the effect of amending the original official zoning map or any subsequent amendment thereof. The new official zoning map shall be identified by the signature of the mayor attested by the city clerk-treasurer, and bearing the seal of the city under the following words:

This is to certify that this official zoning map supersedes and replaces the official zoning map adopted (date of adoption of map being replaced) as part of Ordinance No. ___ of the city of Leavenworth, Washington.
