3.44.010 Payment of claims against city arising in tort – Created – Expenditures.

(1) There is created and established a cumulative reserve fund which shall be designated as “cumulative reserve fund for the payment of claims against the city arising in tort.”

(2) The moneys in said fund may be allowed to accumulate from year to year until the city council determines to expend the same for the purpose of paying claims against the city arising in tort; provided, that any moneys in said fund shall never be expended for any other purpose than that above specified, without an approving vote by a majority of the electors of the city at a general or special election voting on a proposal submitted to the electors to allow other specified uses to be made of said fund. 3.44.020 Payment of claims against city arising in tort – Inclusion in budget.

(1) An item for said cumulative reserve fund mentioned in LMC 3.44.010 may be included in the annual budget of the city within the limits and as authorized by law, and said item may be repeated from year to year until in the judgment of the city council the amount required for the specified purpose has been raised or accumulated.

(2) Any moneys in said fund at the end of the fiscal year shall not lapse nor shall the same be a surplus available or which may be used for any other purpose than that specified, except as provided in LMC 3.44.010. (Ord. 407 § 2, 1942).

3.44.030 Replacement of damaged personal property of the city – Created – Expenditures.

(1) There is created and established a cumulative reserve fund which shall be designated as “cumulative reserve fund for the replacement of personal property of the city damaged or destroyed by fire or other accident or casualty.”

(2) The moneys in said fund may be allowed to accumulate from year to year until the city council determines to expend the same for the purpose of paying for the replacement of personal property of the city damaged or destroyed by fire or other accident or casualty; provided, that any moneys in said fund shall never be expended for any other purpose than that above specified, without an approving vote by a majority of the electors of the city at a general or special election voting on a proposal submitted to the electors to allow other specified uses to be made of said fund. 3.44.040 Replacement of damaged personal property of the city – Inclusion in budget.

(1) An item for said cumulative reserve fund mentioned in LMC 3.44.030 may be included in the annual budget of the city within the limits and as authorized by law, and said item may be repeated from year to year until in the judgment of the city council the amount required for the specified purpose has been raised or accumulated.

(2) Any moneys in said fund at the end of the fiscal year shall not lapse nor shall the same be a surplus available or which may be used for any other purpose than that specified, except as provided in LMC 3.44.030. (Ord. 407 § 6, 1942).

3.44.050 Multipurpose fund – Created – Expenditures.

(1) There is created and established a cumulative reserve fund which shall be designated as “cumulative reserve fund for the payment of tort claims against the city, repair or replacement of personal property of the city damage or destroyed by fire, accident or other casualty, and the payment of insurance premiums for such public liability and property damage insurance as the city council upon the recommendation of the city manager shall from time to time deem necessary.”

(2) The moneys in said fund shall be allowed to accumulate from year to year until the city council determines to expend the same for one or more of the purposes specified in subsection (1) of this section; provided, that any moneys in said fund shall never be expended for any other purpose than those specified in subsection (1) of this section without an approving vote by a majority of the electors of the city at a general or special election voting on a proposal submitted to the electors to allow other specified uses to be made of said fund. 3.44.060 Multipurpose fund – Including item in budget.

(1) An item for said cumulative reserve fund mentioned in LMC 3.44.050 may be included in the annual budget of the city within the limits and as authorized by law, and said item may be repeated from year to year until in the judgment of the city council the amount required for the specified purposes has been raised or accumulated.

(2) Any moneys in said fund at the end of any fiscal year shall not lapse nor shall the same be a surplus available or which may be used for any other purpose than those specified, except as provided in LMC 3.44.050. (Ord. 1879 § 1, 1977).

3.44.070 Acquisition of two building sites – Created – Expenditures.

(1) There is created and established a cumulative reserve fund which shall be designated as “cumulative reserve fund for acquiring two building sites and for erecting and maintaining thereon two buildings for municipal purposes.”

(2) The moneys in said fund may be allowed to accumulate from year to year until the city council determines to expend the same for the purpose of acquiring two building sites and for erecting and maintaining thereon two buildings for municipal purposes; provided, that any moneys in said fund shall never be expended for any other purpose than that above specified without an approving vote by a majority of the electors of the city at a general or special election voting on a proposal submitted to the electors to allow other specified uses to be made of said fund. 3.44.080 Acquisition of two building sites – Inclusion in budget.

(1) An item for said cumulative reserve fund mentioned in LMC 3.44.070 may be included in the annual budget of the city within the limits and as authorized by law, and said item may be repeated from year to year until in the judgment of the city council the amount required for the specified purpose has been raised or accumulated.

(2) Any moneys in said fund at the end of the fiscal year shall not lapse nor shall the same be a surplus available or which may be used for any other purpose than that specified, except as provided in LMC 3.44.070. (Ord. 407 § 8, 1942).

3.44.090 Municipal buildings and park sites – Created – Expenditures.

(1) There is created and established a cumulative reserve fund which shall be designated as “cumulative reserve fund for the purpose of constructing and furnishing municipal buildings; the acquisition of equipment therefor, except office equipment; the acquisition of park sites and the construction and equipping of buildings thereon, except for office equipment; and the purchasing or acquisition of playground and park equipment for public parks and playgrounds for the respective departments operating under the current expense fund of the city of Longview.”

(2) The moneys in said fund may be allowed to accumulate from year to year. No department head or other official of the city shall authorize the expenditure of any money from this fund without the prior express approval of the city council acting in formal session at which session it shall be determined that any expenditure so authorized by the city council is for one or more of the purposes for which said fund is established; provided, that any moneys in said fund shall never be expended for any other purposes than those aforesaid without an approving vote by a majority of the electors of the city at a general or special election, voting on a proposal submitted to the electors to allow other specified uses to be made of said fund. 3.44.100 Municipal buildings and park sites – Inclusion in budget.

(1) Separate items for said cumulative reserve fund mentioned in LMC 3.44.090 may be included in the annual budget of the city, within the limits and as authorized by law, and said items may be repeated from year to year until in the judgment of the city council the amounts required for the specified purposes aforesaid have been raised or accumulated.

(2) Any moneys in the fund at the end of any fiscal year shall not lapse nor shall the same be a surplus available or which may be used for any other purposes than those specified, except as provided in LMC 3.44.090. (Ord. 1346 § 1, 1967).

3.44.110 Acquisition of sites for municipal buildings – Created – Expenditures.

(1) There is created and established a cumulative reserve fund, which shall be designated as “cumulative reserve fund for the purpose of acquiring sites for, constructing, equipping and furnishing municipal buildings within the city of Longview.”

(2) The moneys in said fund may be allowed to accumulate from year to year until the city council determines to expend the same for the purpose of acquiring sites for and/or constructing and/or equipping and furnishing the municipal buildings within the city; provided, that any moneys in said fund shall never be expended for any other purpose than that above specified without an approving vote by a majority of the electors of the city at a general or special election, voting on a proposal submitted to the electors to allow other specified uses to be made of said fund. 3.44.120 Acquisition of sites for municipal buildings – Inclusion in budget.

(1) Separate items for said cumulative reserve fund mentioned in LMC 3.44.110 may be included in the annual budget of the city, within the limits and as authorized by law, and said items may be repeated from year to year until in the judgment of the city council the amounts required for the specified purposes have been raised or accumulated.

(2) Any moneys in said funds at the end of the fiscal year shall not lapse nor shall the same be a surplus available or which may be used for any other purposes than that specified, except as provided in LMC 3.44.110. (Ord. 734 § 3, 1954).

3.44.130 Park site acquisition – Created – Expenditures.

(1) There is created and established a cumulative reserve fund, which shall be designated as “cumulative reserve fund for the purpose of acquiring park sites, improvement and betterment of existing or future acquired parks and equipping the same with public improvements and/or recreational facilities, all within the city of Longview.”

(2) The moneys in said fund may be allowed to accumulate from year to year until the city council determines to expend the same for acquiring park sites and/or improvement and betterment of existing or future acquired parks and/or equipping such parks with public improvements and/or recreational facilities, all within the city; provided, that any moneys in said fund shall never be expended for any other purpose than above specified without an approving vote by a majority of the electors of the city at a general or special election, voting on a proposal submitted to the electors to allow other specified uses to be made of said fund. 3.44.140 Park site acquisition – Inclusion in budget.

(1) Separate items for said cumulative reserve fund mentioned in LMC 3.44.130 may be included in the annual budget of the city, within the limits and as authorized by law, and said items may be repeated from year to year until in the judgment of the city council the amounts required for the specified purposes have been raised or accumulated.

(2) Any moneys in said fund at the end of the fiscal year shall not lapse nor shall be same be a surplus available or which may be used for any other purposes than those specified, except as provided in LMC 3.44.130. (Ord. 799 § 3, 1955).

3.44.170 Purchase of fire fighting equipment – Created – Expenditures.

(1) There is created and established a cumulative reserve fund which shall be designated as “cumulative reserve fund for the purchase of additional fire fighting equipment.”

(2) The moneys in said fund may be allowed to accumulate from year to year until the city council determines to expend the same for the purpose of purchasing additional fire fighting equipment; provided, that any moneys in said fund shall never be expended for any other purpose than that above specified without an approving vote by a majority of the electors of the city at a general or special election voting on a proposal submitted to the electors to allow other specified uses to be made of said fund. 3.44.180 Purchase of fire fighting equipment – Inclusion in budget.

(1) An item for said cumulative reserve fund mentioned in LMC 3.44.170 may be included in the annual budget of the city within the limits and as authorized by law, and said item may be repeated from year to year until in the judgment of the city council the amount required for the specified purpose has been raised or accumulated.

(2) Any moneys in said fund at the end of the fiscal year shall not lapse nor shall the same be a surplus available or which may be used for any other purpose than that specified, except as provided in LMC 3.44.170. (Ord. 407 § 4, 1942).

3.44.310 Street improvements – Created – Expenditures.

(1) There is created and established a cumulative reserve fund, which shall be designated as “cumulative reserve fund for street improvements within the city of Longview.”

(2) The moneys in said fund may be allowed to accumulate from year to year until the city council determines to expend the same for street improvements within the city; provided, that any moneys in said fund shall never be expended for any other purpose than that above specified without an approving vote by a majority of the electors of the city at a general or special election, voting on a proposal submitted to the electors to allow other specified uses to be made of said fund. 3.44.320 Street improvements – Inclusion in budget.

(1) Separate items for said cumulative reserve fund mentioned in LMC 3.44.310 may be included in the annual budget of the city, within the limits and as authorized by law, and said items may be repeated from year to year until in the judgment of the city council the amounts required for the specified purposes have been raised or accumulated.

(2) Any moneys in said fund at the end of the fiscal year shall not lapse nor shall the same be a surplus available or which may be used for any other purposes than that specified, except as provided in LMC 3.44.310. (Ord. 734 § 3, 1954).

3.44.330 Street lighting equipment – Created – Expenditures.

(1) There is created and established a cumulative reserve fund, which shall be designated as “cumulative reserve fund for the purchase and installation of street lights and lighting wires, equipment and apparatus.”

(2) The moneys in said fund may be allowed to accumulate from year to year until the city council determines to expend the same for the purpose of purchasing and installing street lights and light wires, equipment and apparatus in the city; provided, that any moneys in said fund shall never be expended for any other purpose than that above specified without an approving vote by a majority of the electors of the city at a general or special election, voting on a proposal submitted to the electors to allow other specified uses to be made of said fund. 3.44.340 Street lighting equipment – Inclusion in budget.

(1) An item for said cumulative reserve fund mentioned in LMC 3.44.330 may be included in the annual budget of the city, within the limits and as authorized by law, and said item may be repeated from year to year until in the judgment of the city council the amount required for the specified purpose has been raised or accumulated.

(2) Any moneys in said fund at the end of the fiscal year shall not lapse nor shall the same be a surplus available or which may be used for any other purpose than that specified, except as provided in LMC 3.44.330. (Ord. 502 § 2, 1946).

3.44.350 Major office equipment – Creation – Expenditures.

There is created and established a cumulative reserve fund which shall be designated as “cumulative reserve fund for the purpose of purchasing major office equipment for departments operating under the general fund of the city.” The moneys in the fund may be allowed to accumulate from year to year until the city council determines to expend the same for the purchase of major office equipment by departments operating under the general fund of the city; provided, that any amount in the fund shall never be expended for any other purpose than aforesaid without an approving vote by a majority of the electors of the city at a general or special election, voting on a proposal submitted to the electors to allow other specified uses to be made of the fund. 3.44.360 Major office equipment – Inclusion in budget.

Separate itemized amounts for said cumulative reserve fund may be included in the annual budget of the city, within the limits and as authorized by law, and the itemized amounts may be repeated from year to year until in the judgment of the city council the total amounts required for the specified purposes aforesaid have been raised or accumulated. Any moneys in said fund at the end of the fiscal year shall not lapse nor shall the same be a surplus available to be used for any other purposes than those specified, except as above provided. (Ord. 1687 § 2, 1974).

3.44.370 Major equipment – Appropriations.

The city council further authorizes that certain funds may be appropriated annually from the general fund and placed into the cumulative reserve fund created by LMC 3.44.350 for the purpose of accumulating moneys for the purchase of major office equipment and/or redeeming interest-bearing warrants, together with accrued interest, which have been authorized pursuant to action of the city council and issued against said cumulative reserve fund. (Ord. 1687 § 3, 1974).

3.44.380 Water/sewer depreciation reserve fund.

There is created and established a cumulative reserve fund which shall be designated as “water/sewer depreciation reserve fund,” for major rehabilitation or replacement projects which extend the life of facilities. Such rehabilitation and replacement projects shall be for the purpose of sustaining service without significantly increasing or improving the character of service. The moneys placed in said fund may be allowed to accumulate from year to year until the city council determines to expend the same for such projects; provided, that any moneys in said fund shall never be expended for any other purpose than for the rehabilitation or replacement of the facilities of the water/sewer systems of the city. 3.44.390 Water/sewer construction fund.

There is created and established a cumulative reserve fund, which shall be designated as “water/sewer construction fund” for extensions, expansions or “upgrades” to the water/sewer facilities or to improve such systems. The moneys placed in said fund may be allowed to accumulate from year to year until the city council determines to expend the same for such extensions, expansions or “upgrades”; provided, that any moneys in said fund shall never be expended for any other purpose than for the extension, expansion or “upgrade” of the facilities of the water/sewer systems of the city. 3.44.400 Building replacement fund – Expenditures to be authorized by city council.

There is created and established a cumulative reserve fund which shall be designated as “building replacement fund.” The money placed into said fund shall accumulate from year to year until the city council determines to expend the same. The funds in such reserve fund, including any accumulated interest or other earnings, may be used only for the repair, replacement, renovation, alteration and/or modernization of buildings owned by the city, and for no other purposes, and approved in the city’s budget; provided, however, that in the event that the city should experience a financial emergency caused by a natural or economic disaster or by severe revenue shortfalls, resulting in an inability to provide essential services, the city council may, by ordinance, authorize the expenditure of such funds to provide such services.
