5.76.010 Skill game defined.

“Skill game” means and includes any electrical, mechanical or other amusement device, which said device may be played by the insertion of a coin or coins, excluding billiard tables and pool tables, and which device is not licensed as an “amusement game” by the Washington State Gambling Commission. 5.76.020 License – Required.

No person shall maintain nor permit to be operated in any location in the city for a consideration of value any skill game without first having procured a license to maintain and permit the operation thereof in such location and paying the license fee therefor, as hereinafter provided, and in all other respects complying with the provisions of this chapter. (Ord. 739 § 2, 1954).

5.76.030 License – Application – Issuance – Nontransferable.

(1) All applications for such licenses shall be made to the city clerk.

(2) Upon such application and the payment of the license fee, the clerk shall issue a license for the location desired by the applicant and each license shall have a number and shall contain the name of the licensee, a description of the location and a description of the type of machine, board or device authorized to be operated therein.

(3) Such license shall not be transferred from one location to another, nor from one person to another. It shall be considered as personal to the licensee. (Ord. 739 § 3, 1954).

5.76.040 License – Display required.

It shall be the duty of the licensee to place and maintain such license in plain view of the public in the location licensed and in the immediate vicinity of the machine, board or device to be operated in said location so as to be clearly and readily observed by anyone operating said machine, board or device. (Ord. 739 § 4, 1954).

5.76.050 License – Fees – Payable in advance.

The license fee for any location shall be $50.00 per calendar year, or any part thereof, for each skill game at said location which license fee shall be in addition to any other license fee or tax required by any ordinance of the city. (Ord. 2112 § 1, 1982; Ord. 1568 § 2, 1972; Ord. 739 §§ 5, 6, 1954).

5.76.060 License – Expiration.

All licenses issued pursuant to this chapter shall expire on the thirty-first day of December of the year of issuance unless sooner revoked as herein provided for. (Ord. 739 § 7, 1954).

5.76.070 License – Revocation.

Any such license may be revoked at any time by the city council upon receiving notice of the conviction of the licensee for violation of any provision of this chapter, or for violation of any state or federal law, and thereupon there shall be no refund of any license fee, or any portion thereof. (Ord. 739 § 7, 1954).

5.76.080 Operation by minors prohibited.

No licensee, nor his servant, agent, or employee, shall permit any person under the age of 18 years of age to play or operate any skill game as herein defined. (Ord. 739 § 8, 1954).
