11.02.010 Adoption of Washington Model Traffic Ordinance.

The “Washington Model Traffic Ordinance,” Chapter 308-330 WAC, hereinafter referred to as the “MTO,” is adopted by reference as the traffic ordinance of the city of Longview, as if set forth in this chapter, except as provided in LMC 11.02.020. (Ord. 2553 § 1, 1994).

11.02.020 Sections of MTO not adopted.

The following sections of the MTO are not adopted by reference and are expressly deleted: WAC 308-330-142, 308-330-145, 308-330-148, 308-330-172, 308-330-210, 308-330-215, 308-330-255, 308-330-260, 308-330-265, 308-330-270, 308-330-275, 308-330-375, 308-330-555, 308-330-640, 308-330-650 and 308-330-660. (Ord. 3013 § 1, 2007; Ord. 2553 § 1, 1994).

11.02.030 Disposition of traffic fines and forfeitures.

All fines and forfeitures collected upon conviction or upon the forfeiture of bail of any person charged with a violation of any of the provisions of this chapter shall be paid into the general fund of the city. (Ord. 2553 § 1, 1994).

11.02.040 Copy of MTO text to be filed.

Incident to the adoption of the ordinance codified in this chapter and the enactment of this chapter, copies of the text of the adopted MTO and of the statutes adopted by the MTO shall be authenticated, recorded and/or filed as required by RCW 35A.12.140 and 35A.13.180. (Ord. 2553 § 1, 1994).

11.02.050 Certain sections of the “1994 Omnibus Drunk Driving Act” adopted.

Sections 4, 5, 6, 7, 10, 11, 12 and 23 of Chapter 275, Laws of Washington for 1994, and RCW 46.20.730 are adopted by reference as a part of the traffic ordinance of the city of Longview, as if set forth in this chapter. (Ord. 2556 § 1, 1994).

11.02.060 Copy of text of sections adopted by reference to be filed.

Incident to the adoption of the ordinance codified in this chapter, copies of the text of Sections 4, 5, 6, 7, 10, 11, 12 and 23 of Chapter 275, Laws of Washington for 1994, and RCW 46.20.730 shall be authenticated, recorded and/or filed as required by RCW 35A.12.140 and 35A.13.180. (Ord. 2556 § 1, 1994).

11.02.070 Bicycles – Riding on sidewalks.

(1) No person shall ride a bicycle upon a sidewalk in the commercial districts CBD, O/C, and GC except those sidewalks of that district along Ocean Beach Highway, 15th Avenue, Washington Way, and Commerce Avenue between 15th Avenue and Washington Way, and downtown commerce district (D-C), except a police officer or other emergency personnel during the course of their official duties.

(2) A person may ride a bicycle on any other sidewalk or any roadway unless restricted or prohibited by traffic control devices.

(3) Whenever any person is riding a bicycle upon a sidewalk, such person shall yield the right-of-way to any pedestrian. (Ord. 3202 § 2, 2012; Ord. 3018 § 1, 2007; Ord. 3013 § 2, 2007).
