17.02.010 Effective date, application, severability.

The ordinance codified in this title, hereinafter referred to as “this title” or “this code,” shall be known and may be cited as the Longview environmental code and shall become effective on December 1, 2000. (Ord. 2786 § 1, 2000).

17.02.020 Adoption by reference.

Statutes of the state of Washington, regulations contained within the Washington Administrative Code, ordinances and resolutions of the city of Longview, and any standard code of technical regulations, or portions thereof, adopted by reference in this title, are adopted in accordance with the State Environmental Protection Act (SEPA), RCW 43.21C.120, and the SEPA rules (WAC 197-11-904).

The ordinance codified in this title contains the city’s SEPA procedures and policies. The SEPA rules, Chapter 197-11 WAC, must be used in conjunction with the ordinance codified in this title. (Ord. 2786 § 1, 2000).

17.02.030 Applicability of this title.

The provisions of this title shall apply to any violation of any of the provisions of this title occurring or committed on or after the effective date of the ordinance codified in this title. (Ord. 2786 § 1, 2000).

17.02.040 Inapplicability of this title.

The provisions of this title shall not apply to any violation of any provision of this code occurring or committed prior to the effective date of the ordinance codified in this title. (Ord. 2786 § 1, 2000).

17.02.050 Savings.

Any violation occurring prior to the effective date of the ordinance codified in this title or any prosecution for any violation commenced prior to the effective date of the ordinance codified in this title shall be prosecuted and punished under the provisions of law and this code existing at the time of commission thereof as if this title had not been enacted. (Ord. 2786 § 1, 2000).

17.02.060 Severability.

If any section, subsection, clause, phrase or any portion of this title, whether set forth herein in full or adopted by reference, is for any reason held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this title. The city council declares that it would have adopted the provisions of this title and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. 17.02.070 Fees.

The fees to be paid upon the filing of a petition or application relating to environmental protection review and permits shall be as set forth in Table 17-A of the Longview Municipal Code.

STORMWATER REVIEW

Review of private stormwater retention/detention systems

When submittal documents are incomplete or changed so as to require additional review or when the project involves deferred submittal documents, an additional review fee shall be charged at the rate shown in amended Table 17-A.
