3.57.010 Fund created.

A special improvement project fund is hereby created and established to be known as the “ITS program fund” and will be designated Fund 326. (Ord. 2485 § 1, 2004)

3.57.020 Purpose.

The purpose of the ITS program fund is to accumulate all monies and distribute payments of costs for the development of an intelligent transportation system (ITS) program. The sole purpose of the ITS program is to make traffic flow in Lynnwood more efficient by using technology to more accurately operate signals, and by communicating traffic conditions back to motorists to allow wiser trip choices. All vehicle detection and queue observation cameras now installed and operating, or which will be installed and operated under this program, shall be operated for only the specific use of monitoring, understanding, and communicating traffic conditions on the roadway. Only one exception to this specific use would be if the cameras could assist in the management of a bona fide, occurring public safety emergency. The public works director shall develop standard operating procedures (SOPs) restricting the use of these cameras by Lynnwood employees in accordance with the purpose of this chapter, and shall prohibit any person from using such cameras for any other uses unless specifically authorized by the city council. 3.57.030 Appropriation.

A. The sum of $5,129,000 was included in the 2004-09 Capital Facilities Plan Ordinance No. 2480 in projects ST1997020A, ST1997020B, and ST2004072A. The same is hereby appropriated for the “ITS program” as follows:

B. The appropriation for the ITS program fund shall not lapse and shall be carried forward from year to year until fully expended or the purpose has been accomplished or abandoned without the necessity of reappropriation. (Ord. 2569 § 1, 2005; Ord. 2485 § 1, 2004)

3.57.050 Authorization.

Authorization is hereby granted to the public works director, under direction of the mayor, to assume full and complete responsibility for conducting all tasks and doing all things necessary to accomplish the actions authorized in this chapter. (Ord. 2485 § 1, 2004)
