11.44.065 Municipal property.

A. No person shall park any vehicle in any garage, parking area or other property owned and/or operated by the city of Lynnwood, where signs prohibit such parking without lawful authority or permission.

B. Authority to Erect Signs. The city traffic engineer is authorized to erect signs indicating no parking in any garage, parking area, or other property owned and/or operated by the city of Lynnwood when, in his discretion, circumstances require the control of stopping, standing, or parking of vehicles in any garage, parking area or any other property owned and/or operated by the city of Lynnwood.

C. Obedience to Signs. When official signs prohibiting parking in any garage, parking area, or other property owned and/or operated by the city of Lynnwood are erected as authorized in this section, no person shall park a vehicle in violation of said sign. (Ord. 1073 § 1, 1979)

11.44.070 Application of chapter.

The provisions of this chapter prohibiting the standing or parking of a vehicle shall apply at all times or at those times specified in this chapter or as indicated on official signs, except when it is necessary to stop a vehicle to avoid conflict with other traffic or in compliance with the directions of a police officer or official traffic-control device. 11.44.080 Regulations not exclusive.

The provisions of this chapter imposing a time limit on parking shall not relieve any person from the duty to observe other and more restrictive provisions prohibiting or limiting the stopping, standing, or parking of vehicles in specified places or at specified times. (Ord. 219 § 85, 1964)

11.44.085 Licenses and plates required – Parked vehicles.

It shall be unlawful for a person to park or leave any vehicles, including any type of trailer, semi-trailer, or motorcycle, along or on a street or highway, or on any property owned by the city or subject to an easement in favor of the city, in the city of Lynnwood without first having obtained and having in full force and effect a current and proper vehicle license and displaying, as required by Chapter 46.16 RCW, vehicle license number plates, with the current tab showing renewal; provided, that this section shall not apply to vehicles exempted by RCW 46.16.010 as now or hereafter amended. 11.44.090 Parking prohibited at all times on certain streets.

When signs are erected giving notice thereof, no person shall park a vehicle at any time upon any of the following described streets in any area which may be so posted:

11.44.095 Parking prohibited in residential areas.

A. It is unlawful to park, on any street or highway in the city of Lynnwood within or abutting an area classified as residential (RS-8, RS-7, RS-4, RML, RMM or RMH) by the official zoning ordinance, the following types of trailers and/or vehicles:

1. All types of trailers designed to be drawn by a motor vehicle except recreation trailers;

2. Commercial vehicles. For purposes of this section, “commercial vehicle” means any motor vehicle the principal use of which is the transportation of commodities, merchandise, produce, freight, vehicles, animals, passengers for hire, or which is used primarily in construction or farming, including but not limited to bulldozers, backhoes, tractors and cranes. It shall be a defense to a violation of this section that during the entire time that the vehicle was parked in the residential neighborhood the operator of the vehicle was actively engaged in making a delivery or providing services to residents in the immediate vicinity of where the vehicle was parked.

B. It is unlawful to park or otherwise leave on any street or highway in the city of Lynnwood, within or abutting an area classified as residential (RS-8, RS-7, RS-4, RML, RMM or RMH) by the official zoning ordinance, any recreation trailer if such trailer:

1. Is so parked illegally as to constitute a definite hazard or obstruction to the normal movement of traffic; or

2. Has been parked or left standing in any public street or alley for any continuous period of time of more than 168 hours.

C. It is not necessary that restricted parking or other traffic signs be erected for the purpose of enforcing this section. (Ord. 2821 § 2, 2010; Ord. 2164 § 15, 1997; Ord. 809 § 1, 1975; Ord. 783 § 1(B), 1975)

11.44.100 Parking prohibited during certain hours on certain streets.

When signs are erected giving notice thereof, no person shall park a vehicle at any time on either side of the street on:

A. 68th Avenue W from 196th Street SW to 204th Street SW other than commencing at 12:00 midnight Friday to 12:00 midnight Sunday;

B. 202nd Street SW from Highway 99 to 68th Avenue W between the hours of 8:00 a.m. and 7:00 p.m. other than commencing at 8:00 a.m. on Saturday to 7:00 p.m. on Sunday, or as may be specifically otherwise posted.

11.44.105 Traffic engineer – Authority.

The city traffic engineer or his/her designee is authorized to determine and designate by proper traffic control signs zones not exceeding 300 feet in length for no parking, stopping, or standing of vehicles where the primary basis of such zone is safety or spillover parking concerns. 11.44.140 Traffic infraction.

A. Failure to perform any act required or the performance of any act prohibited by this chapter is a traffic infraction. The penalty for such infraction shall be $30.00; provided, however, that the fine for an infraction prosecuted under Chapter 11.18 LMC shall be $112.00; and provided further, that whenever, in the future, the state of Washington increases the fine imposed under Chapter 11.18 LMC, by legislation or court rule, the city’s fine shall be increased to a like amount upon the effective date of such legislation or court rule.

B. Any person having been assessed a penalty for an infraction under this code must pay that penalty in the time provided on the ticket or imposed by the court. The court shall impose a penalty in the amount of $25.00 for failure to respond as required by the notice of infraction or pay any penalty imposed under this section within the time required.
