16.50.010 Purpose.

This chapter establishes a procedure for appeals of administrative decisions and interpretations of LMC Titles 9, 15 and 16. (Ord. 2505 § 8, 2004)

16.50.020 Powers and duties of the hearing examiner.

All appeals authorized by those codes adopted by LMC Titles 9, 15 and 16 as to the suitability of alternate materials and methods of construction and from other rulings, interpretations or enforcement action of those officials charged with enforcing said codes, shall be brought before the city’s hearing examiner pursuant to the provisions of this chapter and Chapter 2.22 LMC. The hearing examiner shall serve in lieu of all boards of appeal mentioned or described in the codes adopted in LMC Titles 9, 15 and 16 and said codes are hereby amended to the extent necessary to provide for such substitution. 16.50.030 Procedure of hearings.

The procedures set forth in LMC 1.35.200 through 1.35.260 shall apply to all appeals under this chapter. (Ord. 2505 § 8, 2004)

16.50.040 Fees.

Fees for appeals and hearings under this chapter shall be as set forth in Chapter 3.104 LMC. (Ord. 2656 §§ 1, 2, 2006; Ord. 2505 § 8, 2004)

16.50.900 Severability.

If any section, subsection, paragraph, sentence, clause, word or phrase of this chapter should be held to be invalid or unconstitutional by a court of competent jurisdiction such invalidity or unconstitutionality shall not affect the validity or constitutionality of any other section, subsection, paragraph, sentence, clause, word, or phrase of this chapter.
