2.20.010 Office created.

There is hereby created the office of the City Clerk in and for the City, pursuant to the laws of the State of Washington. This office shall be filled by appointment of the City Manager with the concurrence of the City Council. (Ord. O-99-81 § 1; Ord. O-97-33 § 1).

2.20.020 Duties.

A. The City Clerk shall keep a full and true record of every proceeding of the City Council and keep such books, accounts and make such reports as may be required by the Division of Municipal Corporations in the office of the State Auditor. The City Clerk shall record all ordinances, annexing thereto his or her certificate, giving the number and title of the ordinance, stating that the ordinance was published and posted according to the law and that the record is a true and correct copy thereof. The record copy with the Clerk’s certificate shall be prima facie evidence of the contents of the ordinance and of its passage and publication, and shall be admissible as such evidence in any court or proceeding.

B. The City Clerk shall be custodian of the seal of the City, and have authority to acknowledge the execution of all instruments by the City which require acknowledgment.

C. The City Clerk may appoint a deputy for whose acts he/she and his/her deputy shall have authority to take all necessary affidavits and claims against the City and certify them without charge.

D. The City Clerk shall perform such other duties as may be now or hereinafter required by statute or ordinance. (Ord. O-97-33 § 2).

2.20.030 Compensation.

The City Clerk shall receive such salary and in such amounts as the Council may, from time to time, establish by ordinance and as fixed by the City’s annual budget.* (Ord. O-97-33 § 3).

2.20.040 Agent to receive claims for damages – Claims procedure.

A. Designation of Agent. The City Clerk, or Deputy City Clerk, in the City Clerk’s absence, is hereby appointed to be the City agent responsible to receive claims for damages made under Chapter 4.96 RCW, as written or hereafter amended. A claim is deemed presented when the claim form is delivered in person or is received by the City Clerk by regular mail, registered mail, or certified mail, with return receipt requested. All claims for damages must be presented on the standard tort claim form, which is available in the Clerk’s Office at City Hall, or on the City’s website at: www.maplevalleywa.gov. Claims may not be presented via email or facsimile transmission. The City Clerk, or Deputy City Clerk, shall be available to receive claims for damages during normal City Hall business hours as established by MVMC 2.05.010 at Maple Valley City Hall, 22017 SE Wax Road, Suite 200, P.O.
