IRRIGATION WATER ON PUBLIC ROADS

12.08.010 Prohibition.

No person, firm or corporation shall operate any irrigation system or procedure which results in irrigation water sprinkling upon, running over or within any portion of the maintained area of any public road right-of-way in the town.

12.08.020 Maintained area defined.

The term “maintained area” shall include that portion of the public right-of-way currently occupied by the traveled way, and the appurtenances thereto; the appurtenances shall include road shoulders, roadside drainage ditches, road embankment slopes and road cut slopes.

12.08.030 Violation—Penalty.

A violation of any provision of this chapter shall constitute a civil violation, punishable by a fine of not more than five hundred dollars.

12.08.040 Exemption.

It shall not be a violation of this chapter if the irrigation water sprinkling upon, running over or within any portion of the maintained area of the roadway is a result of the natural elements, wind, or act of God.
