17.68.010 Applicability.

The regulations, restrictions, and boundaries set forth in this title may from time to time be amended, supplemented, modified, or repealed in accordance with the following procedures, provided that no change shall be approved that is inconsistent with the Mattawa comprehensive plan.

17.68.020 Procedures.

A. Initiation. Amendments, supplementations, modifications, or repeals of or to this title may be initiated by the following:

1. The Mattawa town council;

2. The Mattawa planning commission;

3. Property owners by:

a. Filing with the town clerk a petition signed by one or more property owners within the town setting forth the proposed change and the reasons therefor, and

b. Payment of the fee prescribed in Section XIII of the ordinance codified in this title to help defray the cost of processing the petition,

c. The petition must be filed at least thirty days prior to the date of the planning commission hearing where the petition will be considered.

B. Public Hearings Required. Proposed amendments, supplementations, modifications, or repeals of or to this title shall first be heard at a public hearing by the planning commission. The recommendation of the planning commission shall be made and reported to the town council within ninety days of the time that the petition was filed. No request for a zone boundary or zone classification amendment to this title shall be reconsidered by the planning commission within the twelve-month period immediately following a previous denial of such request. The planning commission may consent to a new hearing if, in the opinion of the planning commission, such a hearing is warranted by new evidence or a substantial change of circumstances.

C. Notice Required. The following public notice requirements shall be followed:

1. Planning Commission Hearing—Rezone. Notice of a planning commission hearing for consideration of an amendment to the official zoning map shall be given as follows:

a. Upon the determination of receipt of a complete application, the administrator shall cause not less than three copies of a notice of public hearing thereof to be posted in conspicuous places with at least one on the property in question, giving notice of the time and place where such hearing is to be held; which notice is to be posted not less than ten days prior to the date thereof;

b. Within fourteen days following receipt of a complete application, notice will be provided to the public and agencies with jurisdiction containing the project description, permits applied for, other permits required, existing environmental documents that evaluate the proposed dates of the public comment period, hearing date (if any), and a statement of the development regulations which will be used.

2. Planning Commission Hearing—Text Changes. Notice of a planning commission hearing for consideration of a text amendment to the Mattawa zoning ordinance shall be given as follows:

a. By publishing a notice of hearing in a newspaper of general circulation within the town of Mattawa not less than ten days prior to the date of the hearing;

b. By posting a notice of hearing in three locations within the town in places where public announcements are typically to be found;

c. Within fourteen days following receipt of a complete application, notice will be provided to the public and agencies with jurisdiction containing the project description, permits applied for, other permit required, existing environmental documents that evaluate the proposal, dates of the public comment period, hearing date (if any), and a statement of the development regulations which will be used.

3. Town Council Hearing—Rezones and Text Changes. Notice of a town council hearing for consideration of a petition to change a zoning boundary, or a petition proposing a text amendment to the zoning ordinance, shall be made by the posting of at least three copies of the hearing notice in the vicinity of the land in question or locations within the town where public announcements are typically to be found.

17.68.030 Review of decision.

Any decision approving or disapproving any amendment modification, or repeal of or to this title shall be reviewed in the superior court of Grant County on the basis of unlawful, arbitrary, or capricious action or nonaction by writ of review or mandamus, provided that the application for such writ shall be made to the court within twenty-one days from the date of the decision sought to be reviewed.

17.68.040 Zoning of annexations.

At the time of the official public hearing in any proposed annexation of property to the town, the town council shall stipulate precisely the zoning classification or classifications of the area to be annexed as a part of the annexation ordinance and the official zoning map shall be changed accordingly. The zoning classification or classifications applied to the newly annexed area or areas shall be consistent with and as shown on the land use designations map in the Mattawa comprehensive plan.
