4.32.010 Permit required--Fee.

It shall be unlawful for any person, firm or corporation to engage in the retail sale of, or to sell any fireworks within the city without first having obtained a permit. (Ord. 1058 §1, 1977: Ord. 884 §1, 1968).

4.32.020 Issuance.

A permit for the sale of fireworks shall be issued only upon the following terms and conditions:

(a)    The applicant shall have a valid and subsisting license issued by the state of Washington authorizing the holder thereof to engage in the fireworks business;

(b)    The applicant must be a nonprofit organization transacting its business and affairs in the city. (Ord. 884 §2, 1968).

4.32.030 Application.

All applications for a permit hereunder shall be made in writing to the chief of the fire department not less than ten days prior to the proposed sale or display of fireworks hereunder. (Ord. 884 §3, 1968).

4.32.040 Stands required.

All safe and sane fireworks, except toy caps, shall be sold only from stands, and the stands must conform to the regulations of the fire chief. (Ord. 884 §4, 1968).

4.32.050 Term of permit.

All permits issued hereunder shall be for the term of one year, running from January 1st to December 31st, and shall be issued only upon approval of the city council. (Ord. 884 §5, 1968).

4.32.052 Sale and discharge permitted when.

Consumer fireworks, as that term is defined in RCW 70.77.136, as now existing or hereafter amended or succeeded, shall be sold, possessed, or discharged by any person only during such hours during the months of June and July of each calendar year as may be established in RCW 70.77.395, as now existing or hereafter amended or succeeded; provided, that no sale, use, possession, or discharge shall occur or be allowed during any other period, including but not limited to, December 28, 29, 30, 31 or January 1 of any calendar year unless permitted under the authority of RCW 70.77.311.

Any person who violates the provisions of this section shall be guilty of a criminal offense under the municipal code and upon conviction, be subject to punishment as provided in Section 1.08.010 of this code. (Ord. 1455 §1, 2002: Ord. 1365 §1, 1995).

4.32.055 Use of fireworks.

(a)    No use or display of common fireworks by private citizens shall occur within the corporate limits of the city upon public property or rights-of-way and only within the confines of the private property owned or occupied by the person using or displaying the same or within the owner or occupier's permission.

(b)    No use or display of common fireworks shall occur within the corporate limits of the city which unreasonably disturbs or invades the privacy or property of persons. (Ord. 1329 §1, 1992).

4.32.060 Implementation of state statute.

This chapter is intended to implement RCW 70.77 and shall be construed in connection with that law and any and all rules and regulations issued pursuant thereto. (Ord. 884 §6, 1968).

4.32.070 Enforcement of chapter.

The fire chief of the city or his duly authorized representative is designated as the enforcing officer of this chapter and he shall have the authority to revoke any license whenever a licensee has violated any section of this chapter. (Ord. 884 §7, 1968).
