5.12.010 Speed limit--Riding areas excluded.

It is unlawful for any person or persons to ride, lead or drive any horse, mare, donkey, mule or saddle or work animal, or a team thereof, of any description in, over or upon any street, alley or public highway within the city of Montesano faster than an ordinary travelling gait, or to ride, lead or drive any such animal or animals across or onto any sidewalk, parking strip, public park, or upon the private property of another or into any place of business or dwelling house of another, within the city of Montesano. 5.12.020 Unlawful areas and exceptions.

It is unlawful to have any unmounted horse, mare, donkey, mule or saddle or work animal within the city limits of Montesano, except on the owner's property, unless it is an animal or team drawing a wagon or cart under the control of a driver, and for every unmounted riding animal, one person must be in contact with the animal at all times.

It is unlawful to ride, lead or drive any horse, mare, donkey, mule or saddle or work animal, except on the owner's property, within a restricted area in the city of Montesano bounded by 4th Street, Academy Street, Spruce Street and Wynooche Street, except that riding will be allowed on the boundary streets, but on Spruce Street from 3rd Street to Academy Street, only if authorized by the city council by special permit in connection with a public parade or civic celebration. 5.12.030 Hitching.

It is unlawful for any person to tie, hitch or in any manner fasten any horse, horses, mare, donkey, mule or saddle or work animal to any tree, shrub, bush, post, pedestal or any support for a public sign or light fixture upon any street, alley, parking strip or other public place in the city of Montesano; or to any property belonging to a person other than the owner of the animal, unless owner has given permission therefor. 5.12.040 Riding or driving animal-drawn vehicles.

It is unlawful for any person to ride, lead or drive any horse, mare, donkey, mule or saddle or work animal, or any vehicle drawn by such animal or animals, upon a public roadway in the city of Montesano, except in compliance with the rules applicable to all other vehicles using the public roadways. (Ord. 962 (part), 1974).

5.12.050 Lights after dark.

As required by state law, it is unlawful for any person in the city of Montesano to ride, lead or drive any horse, mare, donkey, mule or saddle or work animal after dark (one-half hour after sunset and one-half hour before sunrise) without headlights visible from five hundred feet from the front of the animal and without taillights visible from five hundred feet from the rear of the animal. (Ord. 962 (part), 1974).

5.12.060 Penalties.

Any person found guilty in the police court of the city of Montesano of the violation of any provision of this chapter shall, upon conviction, be fined in any sum not exceeding five hundred dollars or be imprisoned in the city jail for a period not exceeding six months, or be both so fined and imprisoned.
