8.40.010 Malicious mischief.

Any person who knowingly and maliciously causes physical damage to the property of another or who, for the purpose of annoyance or mischief, places in any doorway, sidewalk, street or alley within the city any box, barrel, barrier or other thing shall be guilty of malicious mischief. (Ord. 1204 §2; 1984).

8.40.020 Criminal trespass.

(a)    Any person who knowingly enters or remains unlawfully in a building or knowingly enters or remains unlawfully in or upon the premises of another shall be guilty of criminal trespass.

(b)    It shall be a defense to a charge of criminal trespass that:

(1)    The premises were, at the time, open to members of the public and the defendant complied with all lawful conditions imposed on access to or remaining in the premises; or

(2)    The defendant reasonably believed that the owner of the premises, or other person empowered to license access thereto, would have licensed the defendant to enter or remain. (Ord. 1204 §3(A, B), 1984).

8.40.030 Vehicle prowling.

A person who, with the intent to commit a crime against a person or property therein, enters or remains unlawfully in a vehicle, whether a motor home or otherwise, or a vessel equipped for propulsion by mechanical means or by sail, the vessel having a cab equipped with permanently installed sleeping quarters or cooking facility, shall be guilty of vehicle prowling. (Ord. 1204 §3(C), 1984).

8.40.040 Theft and larceny.

Any person who is found to have committed the offenses specified in this section as those offenses are defined within Chapter 8.04 shall be punished as provided in Section 1.08.010:

(1)    Theft;

(2)    Larceny;

(3)    Criminal possession of leased or rented machinery, equipment, or motor vehicles. (Ord. 1205 §1, 1984).

8.40.045 Possession of stolen property.

Any person who commits the offense of possessing stolen property as that offense is defined by Section 8.04.270, as now existing or hereafter amended or supplanted shall, upon conviction, be punished as provided pursuant to Section 1.08.010 of this code. (Ord. 1279 §3, 1989).

8.40.050 Obscuring the identity of a machine.

Any person who is convicted of the offense of "obscuring the identity of a machine" as that offense is defined within Chapter 8.04 shall be punished as provided in Section 1.08.010. (Ord. 1205 §2, 1984).

8.40.060 Theft of livestock.

Any person who is found guilty of the offense of "theft of livestock" as that offense is defined within the provisions of Chapter 8.04 shall be punished as provided by Section 1.08.010. (Ord. 1205 §3, 1984).

8.40.070 Unlawful issuance of checks or Drafts.

Any person who is found guilty of the offense of "unlawful issuance of checks or drafts" shall be punished as provided by Section 1.08.010. (Ord. 1205 §4, 1984).

8.40.080 Vehicle theft--Riding in stolen vehicle.

Every person who shall, without permission of the owner or person entitled to the possession thereof, intentionally take or drive away any automobile or vehicle, whether propelled by electricity, internal combustion, or by any other means, which is the property of another, and every person voluntarily riding in or upon said automobile or vehicle with knowledge of the fact that the same was unlawfully taken, shall be equally guilty with the person taking or driving said automobile or vehicle. Upon conviction, any such person shall be punished as provided in Section 1.08.010 of this code. (Ord. 1279 §4, 1989).
