17.12.010 Purpose.

The purpose of this title is to classify uses in such a manner to group as nearly as possible those uses which are mutually compatible, to protect each group of uses from the intrusion of incompatible uses which would destroy the security and stability of land improvements, and to implement the goals, objectives, and policies of the Montesano comprehensive plan. (Ord. 1366 (part), 1995).

17.12.020 Zoning map.

The ordinance codified in this title shall consist of the text to this title and of that certain map identified by the approving signatures of the mayor and city clerk-controller marked "Zoning Map of the City of Montesano," the same now on file with the city clerk-controller. This chapter and each of its terms are to be read and interpreted in the light of the contents of the map. A copy of the ordinance codified in this title, duly certified by the city clerk-controller, and a copy of the map, duly certified by the city clerk-controller, shall be filed with all offices required by law. A reproducible copy of the map shall be filed and kept in the office of the clerk-controller. (Ord. 1366 (part), 1995).

17.12.030 Use classifications.

In order to accomplish the purpose of this title, the following use districts are established for the city of Montesano and are noted on zoning map.

(1)    Primary Districts.

(A)    Low-density residential or "R-1" district.

(B)    Moderate-density residential or "R-2" district.

(C)    High-density residential or "R-3" district

(D)    General commercial or "C-1" district.

(E)    Heavy commercial--light industrial or "C-2" district.

(F)    Industrial or "I" district.

(G)    Major public use or "MPU" district.

(H)    Rural residential or "R" district.

(I)    Residential manufactured housing park or "R-MHP."

(2)    Combining Districts.

(A)    Planned development or "PD" district.

(B)    Flood hazard or "FH" district. (Ord. 1366 (part), 1995).

17.12.040 Zone boundary changes.

Changes in the boundaries of the zones created in Section 17.12.030 shall be by ordinance. (Ord. 1366 (part), 1995).

17.12.050 Interpretation.

Where uncertainty arises as to the boundaries of any zone shown upon the map, the following shall apply:

(1)    If any conflict between the zoning map and the text of this title shall arise, the text of this title shall prevail.

(2)    Where a zone boundary is shown on the map as being a lot line, such lot line as surveyed on the ground or established on the ground as a lot line by a final decision of a court of competent jurisdiction shall constitute such boundary.

(3)    Where a zone boundary is shown on the map as the channel of a waterway, the boundary shall be the center of the channel.

(4)    Where a street or alley is officially vacated, the vacated area thereof shall acquire the classification of the abutting property to which ownership of the vacated property is granted.

(5)    In the case of unsubdivided property where a zone boundary is shown on the map as dividing the property, the location of the boundary, unless dimensions are specifically indicated on the map, shall be determined by the use of the scale on the map.

(6)    Areas of dedicated streets, alleys and railroad rights-of-way, unless otherwise classified, shall be deemed unclassified and in the case of streets and alleys shall be permitted to be used only for street and alley purposes as herein defined. Railroad rights-of-way shall be permitted to be used only for accommodating tracks, signals, other operative devices, and the movement of rolling stock. (Ord. 1366 (part), 1995).

17.12.060 Limitations.

Except as provided in this title no building or structure shall be erected, reconstructed or structurally altered, nor shall any building structure, or land be used for any purpose except as hereinafter provided and allowed in the zone in which such building, structure or land is located.
