3.120.010 Establishment of critical areas mitigation program fund.

There is hereby created and established a separate fund to be known as the “CAMP fund” into which (A) all monies and proceeds from the in-lieu fee payment for off-site buffer mitigation program pursuant to RCW 82.02.020 and all other applicable state and federal laws; and (B) all monies received by the city pursuant to the fee-in-lieu of buffer mitigation program shall be deposited in accordance with state and federal laws. 3.120.020 Administration of the fund.

The city administrator or his/her designated representative shall be responsible for the administration of the fund. A simple majority vote of council is needed to approve the fund’s expenditures prior to monies being disbursed from the fund. (Ord. 1310 § 1 (part), 2012)

3.120.030 Purposes—Expenditures.

This fund has been established for the purpose of preserving or replacing wetland and stream buffer functions, and not to finance nonmitigation programs and priorities (e.g., education projects, research). These funds may be used for mitigation project planning, permitting and administration, or for any other direct costs associated with implementation and maintenance of the Mukilteo habitat reserve (MHR). However, only up to ten percent of a project level costs may be used for administrative purposes; this allows for reimbursement of staff time and overhead costs associated with implementing the program on a project level basis. The monies deposited in the CAMP fund shall be expended only for such purposes and for no other purpose when appropriated by the city council. (Ord. 1310 § 1 (part), 2012)

3.120.040 Unexpended funds.

Any unexpended funds will be made available for long-term maintenance of the MHR site and shall be carried forward from year to year until expended for the purposes set forth in Section 3.120.030. (Ord. 1310 § 1 (part), 2012)
