NUMBER OF ANIMALS PERMITTED

6.16.010 Maximum number of dogs and cats.

It shall be unlawful for any person to harbor more than three adult dogs and three adult cats, or any combination of adult dogs and cats exceeding six in number, on one lot without obtaining an animal services facility, commercial kennel, or hobby kennel license from the city and complying with Title 17 zoning regulations for animal services facilities and kennels. 6.16.020 Maximum number of dogs, cats or horses in combination.

It shall be unlawful for any person to harbor more than seven adult dogs, cats, and horses in any combination on one lot, unless an animal services facility or kennel license is obtained from the city and complies with Title 17 zoning regulations for animal services facilities and kennels. Adjacent lots with common ownership shall be considered to be one lot. (Ord. 1267 § 3 (Exh. B) (part), 2011: Ord. 1105 § 2 (part), 2004)

6.16.030 Maximum number of horses or ponies.

A.    It shall be unlawful for any person to harbor a horse or pony on a lot less than allowed within Title 17 zoning regulations.

B.    It shall be unlawful for any person to harbor more than three horses or ponies on one parcel.

C.    In the event a horse or pony gives birth, thereby exceeding the number allowed by the minimum set forth in this section, the owner of said horse and/or the occupier of the premises shall conform to the number of horses or the dimensional requirements within one year of the birth of said animal. 6.16.040 Maximum number of rabbits.

It shall be unlawful for any person to harbor more than four rabbits over four months old on one lot. (Ord. 1267 § 3 (Exh. B) (part), 2011: Ord. 1105 § 2 (part), 2004)

6.16.050 Number of birds.

It shall be unlawful for any person harboring a bird or birds as provided for in this section to harbor:

A.    More than four birds, not counting pigeons, doves and chickens, over four months old on one lot.

B.    More than twelve pigeons and/or doves on one lot.

C.    Chickens.

1.    More than four female chickens on one lot.

2.    Less than two female chickens on one lot.

3.    Harboring of male chickens (roosters) is prohibited. (Ord. 1267 § 3 (Exh. B) (part), 2011: Ord. 1105 § 2 (part), 2004)

6.16.060 Penalties.

A.    Civil Infractions. Any person violating any of the provisions of this chapter is guilty of a civil infraction subject to the provisions contained in Section 1.32.020, Civil infractions. The first offense shall be a Class III civil infraction. The second offense shall be a Class II civil infraction. The third offense shall be a Class I civil infraction.

B.    Misdemeanors. Any person who violates the provisions of this chapter more than three times within a five-year period shall be guilty of a misdemeanor subject to the provisions contained in Section 1.32.010(B). (Ord. 1267 § 3 (Exh. B) (part), 2011: Ord. 1105 § 2 (part), 2004)
