8.18.010 Statutes incorporated by reference.

The following chapters of the Washington Administrative Code are adopted by reference:

A.    Chapter 173-58 WAC—Sound Level Measurement Procedures.

B.    Chapter 173-60 WAC—Maximum Environmental Noise Levels. (Ord. 1355 § 1 (part), 2015: Ord. 925 § 1, 1998)

8.18.020 Noise restrictions.

The noise limitations identified in WAC 173-60-040 shall be reduced by ten dBAs for the receiving property in Class A EDNAs during the following time periods:

A.    Monday through Friday, before seven a.m. and after ten p.m.

B.    Saturdays, Sundays and holidays (as defined in RCW 1.16.050), before nine a.m. and after ten p.m. (Ord. 1355 § 1 (part), 2015: Ord. 940 § 1, 1998)

8.18.030 Exemptions.

With the exception of WAC 173-60-050(3)(a) relating to construction activity, the exemptions to the maximum permissible environmental noise levels set forth in WAC 173-60-050 and 173-60-080, including but not limited to temporary projects for the maintenance or repair of homes, grounds and appurtenances, are hereby adopted by reference. 8.18.040 Penalties.

Violations of this chapter shall constitute a misdemeanor and be subject to the provisions contained in Chapter 1.32, General Penalties. In addition, any violation of this chapter shall be considered a public nuisance and may be abated as such. (Ord. 1355 § 1 (part), 2015)
