18.25.010 Applicability.

Violations of the following code provisions shall constitute a civil infraction subject to the enforcement procedures of this chapter:

A.    Chapter 9.47, Outdoor Storage of Junk and Nuisance Vehicles;

B.    Chapter 17.80, Signs;

C.    Chapter 15.16, Grading and Excavation;

D.    Chapter 17.52 and Chapter 17B.52, Critical Areas Regulations;

E.    Chapter 8.18, Noise Control; and

18.25.020 Authority to issue notices of infraction.

The following shall have the authority to issue notices of civil infraction:

A.    The code compliance officer;

B.    Any law enforcement officer contracting with or employed by the city of Mukilteo with the authority to enforce city, county or state laws within the city; and

C.    The Mukilteo prosecuting attorney. (Ord. 1083 § 26 (part), 2003; Ord. 1057 § 4 (part), 2002)

18.25.030 Rules and procedure.

Civil infractions issued pursuant to this chapter shall be governed by Chapter 7.80 RCW and Infraction Rules for Courts of Limited Jurisdiction, adopted by the Washington State Supreme Court, as now or hereafter amended. (Ord. 1083 § 26 (part), 2003; Ord. 1057 § 4 (part), 2002)

18.25.040 Provisions superseded by conflicting state penalties.

Any violation subject to the enforcement provisions of this chapter that is also subject to conflicting state penalties shall be superseded by the conflicting state penalty provisions. (Ord. 1083 § 26 (part), 2003; Ord. 1057 § 4 (part), 2002)

18.25.050 Schedule of monetary penalties.

Violations enforced under this chapter shall constitute a civil infraction as outlined in Mukilteo Municipal Code Chapter 1.32, General Penalties. The first violation shall constitute a Class III civil infraction, the second offense shall constitute a Class II civil infraction and the third and each violation thereafter within a one-year period shall be classified as a Class I civil infraction. These penalties shall not include statutory assessments. Each day a use or structure remains in violation shall constitute a separate violation under this chapter.
