APPLICABILITY

17.03.010 Applicability.
A. The provisions of this title shall apply to development of existing sites for all multifamily and nonresidential uses, to the clearing and/or grading of all sites, and to development of all approved subdivisions and plats within the corporate limits of the city of Newcastle, except as expressly stated in this title.
B. Exemptions. The provisions of this title shall not apply to the activities described in subsections (B)(1) and (2) of this section.
1. Cemeteries and other burial plots while used for that purpose;
2. Development of existing parcels for one single-family dwelling; provided, that all grading, drainage, and erosion control provisions of the development are addressed in the building permit and are consistent with grading, drainage and erosion control requirements of the underlying subdivision or plat.
