1.04.010 General penalties.

Unless otherwise specified by city ordinance, anyone who violates the provisions of any ordinance shall be punished as follows:

(1) Criminal Penalty. Unless otherwise provided, any person violating any of the provisions of any ordinance of the city is guilty of a misdemeanor. Any person convicted of a misdemeanor under this code shall be punished by a fine not to exceed $5,000 or by imprisonment not to exceed one year, or by both such fine and imprisonment.

(2) Civil Penalty. Any person violating or failing to comply with any of the requirements of the Normandy Park Municipal Code shall be deemed to have committed a civil violation which may be enforced pursuant to NPMC Title 19. Any such person shall be assessed a monetary fine or penalty not to exceed $250.00 for each day, per violation, unless another maximum penalty is specified in this code, and may be further subject to limitations, restrictions and/or other requirements under the code. 1.04.030 Separate offense.

Every person violating any of the provisions of any ordinance of the city is guilty of a separate offense for each and every day during any portion of which the violation is committed, continued or permitted by any such person. (Ord. 795 § 3, 2007).

1.04.040 Nuisance.

In addition to the penalties set forth above, all remedies given by law for the prevention and abatement of nuisances shall apply regardless of any other remedy. (Ord. 795 § 4, 2007).

1.04.050 Severability – Construction.

(1) If a section, subsection, paragraph, sentence, clause, or phrase of this chapter is declared unconstitutional or invalid for any reason by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this chapter.

(2) If the provisions of this chapter are found to be inconsistent with other provisions of the Normandy Park Municipal Code, this chapter is deemed to control. (Ord. 795 § 5, 2007).
