17.36.010 Qualifications.

Access to and from four or fewer lots of a subdivision may be provided by private lane when four or fewer lots of the plat, by virtue of their unique shape or dimensions, cannot, in the judgment of the hearing examiner, reasonably provide a right-of-way, as defined in Chapter 17.32 NPMC, under the following conditions in this chapter. (Ord. 783 § 7, 2006; Ord. 191 § 6(d), 1967).

17.36.020 Total number of lots.

The total number of lots to be served thereby does not exceed four in number. (Ord. 191 § 6(d)(1), 1967).

17.36.030 Building sites.

The total number of building sites is the maximum number of building sites permitted under NPMC Title 18 requirements for area or restrictions of protective deed covenants. (Ord. 191 § 6(d)(2), 1967).

17.36.040 Easements.

Perpetual and reciprocal easements between the several lots of the subdivision shall be recorded with the county auditor. Such easements, generally, shall be for ingress and egress of vehicular and pedestrian traffic, utilities, including those underground, and for the setting of poles, and the stringing of wires. In particular, such easements shall perpetually grant to the city the right of ingress and egress over and upon the same for the exercise of the police power of the city including protection of life, property and general welfare and such easements shall perpetually provide for the obligation of upkeep, maintenance and repair of the private land, in accordance with minimum standards for such work prevailing in the city, so as to insure, in the future, the continuing exercise by the city of its police power in the subdivision. 17.36.050 Width.

Private lanes shall have a minimum width of 20 feet and when serving more than one lot shall be paved to a minimum width of 18 feet according to the standards for construction of private lanes as set forth in NPMC Title 10. (Ord. 191 § 6(d)(4), 1967).

17.36.060 Turn-around area.

A turn-around area shall be provided at the end of all private lanes when serving more than two lots. The turn-around shall have minimum dimensions as shown in NPMC Title 10. (Ord. 191 § 6(d)(5), 1967).

17.36.070 Location approval.

The location of all private lanes and turn-around areas shall be subject to the approval of the planning commission. (Ord. 191 § 6(d)(6), 1967).
