18.68.010 Definitions.

(1) The term “nonroutine commercial traffic” means any commercial vehicle traveling on residential streets that is not delivering goods or providing services to residences of the adjacent neighborhood or to the businesses that directly service that neighborhood.

(2) The term “neighborhood” means the land and the related improvements associated with a particular subdivision plat along with the public streets and private lanes that serve that subdivision and associated surrounding properties. (Ord. 607 § 1, 1995).

18.68.020 Residential neighborhoods – Protected.

The following residential neighborhoods within the city shall be protected by the provisions of the ordinance codified in this chapter:

(1) Arrow Lake;

(2) Arrow Lake Heights;

(3) Beaconsfield on the Sound;

(4) Bonniewood;

(5) Chantilly Terrace;

(6) Colewood;

(7) Danethe Normandy Park Estates;

(8) Glengael;

(9) Happiness Grove;

(10) Henderson Hills;

(11) Lorraine;

(12) Lowe’s Terrace;

(13) Manhatten View;

(14) Maple Lane;

(15) Marvista Heights;

(16) Normandy City View;

(17) Normandy Forest;

(18) Normandy Heights;

(19) Normandy Park Highlands;

(20) Normandy Park Riviera;

(21) Normandy Province;

(22) Normandy Ridge;

(23) Normandy Sunset;

(24) Normandy Timberlane;

(25) Park Cliff;

(26) Shadow Glen Estates;

(27) Shorebrook;

(28) Town of Des Moines (NW of Des Moines Cr.);

18.68.030 Limit on noise impacts.

Residential neighborhoods shall not be subject to adverse land uses, activities or traffic which generate exterior noise exposure levels exceeding an Ldn of 55 dbA, or existing levels as of the effective date of the ordinance codified in this chapter, whichever is greater. (Ord. 607 § 3, 1995).

18.68.040 Requirement for noise mitigation plan.

Proponents of projects which will increase exterior noise levels to which residential areas are exposed above those existing on the effective date of the ordinance codified in this chapter, or above an Ldn of 55 dbA, whichever is higher, must submit a noise mitigation plan to the city planning department for review and approval before required permits are issued to allow the project to proceed. (Ord. 607 § 4, 1995).

18.68.050 Restrictions on vehicles of extraordinary weight.

Pursuant to the authority of Chapter 46.44 RCW, the maximum weight of nonroutine commercial traffic on surface streets in residential neighborhoods shall not exceed 10,000 pounds. (Ord. 607 § 5, 1995).

18.68.060 Severability – Construction.

(1) If a section, subsection, paragraph, sentence, clause or phrase of the ordinance codified in this chapter is declared unconstitutional or invalid for any reason by any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the ordinance codified in this chapter.

(2) If the provisions of the ordinance codified in this chapter are found to be inconsistent with other provisions of this code, the provisions of the ordinance codified in this chapter shall control. (Ord. 607 § 6, 1995).
