SIDEWALK REPAIR AND CONSTRUCTION

11.12.010 Maintenance/repair by abutting property owners.

Whenever any street, lane, square, place or alley in the city has been improved by the construction of a sidewalk along either or both sides thereof, the duty, burden and expense of repair, renewal, maintenance and removal of obstructions from such sidewalk shall be the responsibility of the property owner directly abutting upon said sidewalk. (Ord. 1788 § 2, 2017).

11.12.020 Construction, reconstruction and repair – Procedure.

Whenever the city undertakes the construction, reconstruction or repair of sidewalks, gutters and curbs along and driveways across sidewalks, the city council shall proceed under the authority of and under the procedures provided in Chapter 35.68 RCW, which procedures shall be initiated by the adoption of a resolution by the city council stating whether the cost shall be borne by abutting owner in whole or in part, or requiring the abutting owner to construct the improvement at their own cost and expense. 11.12.030 Construction, reconstruction and repair – Short lengths.

Whenever a portion, not longer than one block in length, of any street in the city is not improved by the construction of a sidewalk thereon, or the sidewalk thereon has become unfit or unsafe for purposes of public travel, and such street adjacent to both ends of such portion is so improved and in good repair, the city council may, by resolution, find that construction or reconstruction of such portion of such street is necessary for the public safety and convenience, and determine to proceed under this section and the duty, burden and expense of constructing or reconstructing shall devolve upon the property directly abutting upon such portion under the authority and the procedures set forth in Chapter 35.69 RCW.
