Article I. General

12.04.010 Definitions.

As used in this chapter:

A. “Authorized campers” means individuals and families who are camping for pleasure and have paid the camping fee established in the city’s fee schedule.

B. “Camper” means any self-contained mobile home mounted on a motorized chassis, or any type of housing or sleeping unit mounted on any other type of vehicle.

C. “Trailer” means any type of wheeled equipment which is towed by another vehicle. (Ord. 940 § 1, 2002)

12.04.020 Littering or disturbing the peace.

Any person or group of persons found to be littering the grounds in city parks by deposit of trash, garbage or other waste material thereon in any place other than receptacles furnished for such purpose, or found to be conducting themselves in a loud or boisterous manner, so as to interfere with the peaceful enjoyment of such premises by other persons, may be ordered to leave the premises, and remove his or her vehicles or equipment, immediately. Such order may be given by any Okanogan County sheriff’s deputy or by city staff designated by the mayor, and failure to obey such order shall be a violation of this chapter. (Ord. 940 § 1, 2002)

12.04.030 Alcohol prohibited.

It is unlawful for any person to possess, consume, sell, give away, or dispose of any intoxicating liquor in city parks, except as authorized in this chapter. (Ord. 940 § 1, 2002)

12.04.040 Mayor authorized to waive provisions.

The mayor of Okanogan is authorized to waive any provision of this chapter as appropriate to facilitate a special recreational activity or event if he/she finds that holding the event or activity and the waiver of the specific provision will be consistent with city parks usage generally and the waiver is for a specific and limited period of time. Said waiver must be in writing and filed in the clerk’s office for the duration of the event. (Ord. 940 § 1, 2002)

12.04.050 Violations – Penalty.

Any violation of the terms of this chapter shall be a civil infraction subject to a penalty not to exceed $500.00. (Ord. 940 § 1, 2002)

Article II. Park Hours

12.04.060 Hours – Established.

All city of Okanogan parks shall be open from 7:00 a.m. to 9:00 p.m. each day except as otherwise authorized in this chapter. (Ord. 940 § 1, 2002)

12.04.070 Mayor authorized to temporarily close parks or amend park hours.

The mayor of Okanogan is hereby authorized to temporarily close or extend or shorten the hours of parks as needed. If a park or parks are closed or hours are to be amended for more than 30 days, it must be approved by the city council. (Ord. 940 § 1, 2002)

Article III. American Legion Park

12.04.080 Camping permitted.

Camping in trailers, campers, or in tents, shall be permitted in American Legion Park by authorized campers for a period not to exceed three consecutive nights. (Ord. 940 § 1, 2002)

12.04.090 Three-night limit.

It is unlawful to park a camper or trailer, or to maintain a tent camp, in American Legion Park for more than three consecutive nights. (Ord. 940 § 1, 2002)

12.04.100 Camping fees.

Fees for camping shall be paid in the sum established by the city council in the city’s fee schedule. (Ord. 940 § 1, 2002)

12.04.110 Alcohol prohibited.

Alcohol shall not be consumed publicly in American Legion Park. Appropriately licensed Washington State wineries and microbreweries registered with the farmers’ market may sell sealed containers of Washington-produced wines or beers, in accordance with Washington State law, during market hours in a designated site in American Legion Park. No sampling or consumption of wine or beer in conjunction with the farmers’ market will be allowed. (Ord. 979 § 1, 2004; Ord. 940 § 1, 2002)

Article IV. Alma Park

12.04.120 Park hours.

Alma Park shall be open from 7:00 a.m. until one-half hour after the city pool closes, or 9:00 p.m., whichever is later. Alma Park shall be open from 7:00 a.m. until 9:00 p.m. on days the pool is not open. (Ord. 940 § 1, 2002)

Article V. Central Valley Sports Complex

12.04.130 Alcohol conditionally allowed.

The city may permit the sale, possession, and consumption of liquor at the Central Valley Sports Complex Park; provided, that those distributing said liquor obtain a license to sell or distribute liquor from the Washington State Liquor Control Board and written permission from the city of Okanogan. Liquor may only be distributed and consumed in a cordoned off area that only adults of at least 21 years of age may enter. The city may impose requirements in addition to those mentioned in this section as a condition of granting permission for the sale or consumption of alcohol at the Central Valley Sports Complex. 12.04.140 Park hours.

The Central Valley Sports Complex Park shall be open the same hours as defined in Article II of this chapter except it may be open from one-half hour prior to the beginning of a game or games that are scheduled with the city of Okanogan and extending to one-half hour after the end of the last game of the day.
