12.04.010 Model Traffic Ordinance adopted by reference—Speed limits on certain streets excepted.

(a)    The Washington Model Traffic Ordinance, being Chapter 308-330 of the Washington Administrative Code, referred to as the “MTO,” is hereby adopted by reference as if fully set forth, except for the speed limits set forth in subsection (b) of this section, and except that the following sections of the MTO are not adopted by reference and are expressly deleted: WAC 308-330-142, 308-330-145, 308-330-148, 308-330-210, 308-330-215, 308-330-225, 308-330-230, 308-330-235, 308-330-240, 308-330-245, 308-330-255, 308-330-265, 308-330-275, 308-330-436, 308-330-600, 308-330-610, 308-330-620, 308-330-630, 308-330-640, 308-330-650, 308-330-660.

(b)    The speed limits on the following streets shall be as follows:

(1)    Omak Avenue extending east from the east side of Dayton Street to the city limits, thirty-five miles per hour, with a school zone thereby established in front of the East Omak School at twenty miles per hour on Omak Avenue when children are present, and a school zone is hereby established on Oak Street commencing at the north Omak city limits, continuing south to and including the intersection of Oak Street and Riverside Drive at twenty miles per hour when children are present;

(2)    On Riverside Drive, commencing at its intersection with Main Street continuing easterly to the Cornerstone Christian Fellowship Church parking lot, twenty-five miles per hour;

(3)    On Riverside Drive, commencing at the Cornerstone Christian Fellowship Church parking lot continuing easterly to its intersection with Highway 97, thirty-five miles per hour;

(4)    On Okoma Drive from the south corporate limits of Omak north to State Milepost 4.49, between Fourth Avenue and Fifth Avenue, thirty miles per hour;

(5)    On Dayton Street from Highway 97 to Omak Avenue, thirty-five miles an hour;

(6)    On Main Street south to Fourth Avenue and thence on Fourth Avenue west to Okoma Drive, and thence on Okoma Drive to State Milepost 4.49, between Fourth Avenue and Fifth Avenue, twenty-five miles per hour;

(7)    The speed limit on Juniper Place from its commencement at Bartlett Avenue running south and west to Juniper Street is reduced to ten miles per hour;

(8)    The speed limit in the school zone established around the Omak High School and Middle School campus on the following streets is hereby established as twenty miles per hour, when children are present: on Second Avenue between Cedar Street and Fir Street; on Central Avenue between Elm Street and Cedar Street; on First Avenue between Fir Street and Elm Street; on Cedar Street between Central Avenue and Second Avenue; and on Fir Street between First Avenue and Second Avenue;

(9)    On Ridge Drive twenty-five miles per hour, with a school zone thereby established in front of the Bethel Christian Academy at twenty miles per hour, when children are present;

(10)    On Copple Road from its intersection with Koala running westerly to the city limits, thirty-five miles per hour;

(11)    On Koala Drive, commencing at its intersection with Quince Street continuing easterly, then northeasterly to the north city limits, thirty-five miles per hour;

(12)    On Shumway Road, commencing at its intersection with Koala Drive continuing westerly to the city limits, thirty-five miles per hour;

(13)    On Engh Road from its intersection with River Road to the Omak city limits, thirty-five miles per hour.

(c)    Appropriate signs will be placed along the street to designate the speed limits; one copy of the foregoing model traffic ordinance and state statutes adopted by reference therein shall be on file in the office of the city clerk. 12.04.020 Application of laws to parks and alleys—Speed limits.

All rules, regulations and penalties for violation thereof as are prescribed in this chapter are made applicable to the roads established for vehicular traffic within the city parks, and to the alleys within the city, except that the speed limit on all such park roads and city alleys shall be fifteen miles per hour. 12.04.040 Penalty for violations.

Failure to perform any act required, or the performance of any act prohibited, by this chapter is designated as a civil infraction and shall not be classified as a criminal offense. Any person, firm or corporation found to have committed such a civil infraction shall be subject to the penalties as set forth in Chapter 1.16. 12.04.050 Severability.

In the event that any provisions of this chapter may be declared unconstitutional or invalid, such shall be considered severable and the remainder of this chapter shall not be affected thereby and shall remain in full force and effect. (Ord. 450 § 5, 1962).
