TRAFFIC ON DIKES

12.22.010 Use restrictions.

(a)    No pedestrians, bicycles, vehicles of any kind or horses, or any other animals, except emergency vehicles under the control of the city of Omak, or with the consent of the city of Omak, or vehicles engaged in the maintenance, repair or construction of the dike, shall go upon or be operated on or over the dikes located within the city of Omak except as follows:

(1)    Pedestrians may use that portion of the dike maintained as a park between Apple Avenue south to Central Avenue on the west side of the river.

(2)    Horses shall be permitted on that portion of the dike on the east side of the river from the Central Street Bridge north to the north city limits.

(3)    Pedestrians shall be permitted on that portion of the dike on the east side of the river.

(4)    Residents and business occupants along Asotin Street, their agents, invitees and guests may use the top of the dike from Central Avenue south to Fourth Avenue for ingress and egress.

(b)    None of the following-listed access sites to the dike shall be blocked at any time, and these access sites shall only be used by emergency vehicles, or vehicles under the control of the city of Omak, or with the consent of the city of Omak, or vehicles engaged in the maintenance, repair, or construction of the dike:

(1)    North off Emery Street fifteen feet east of the east property line to the Sewage Treatment Plant.

(2)    South end of Ash Street at the intersection with the dike.

(3)    West Third Avenue at the intersection with the dike.

(4)    West Second Avenue at the intersection with the dike.

(5)    West end of the Central Avenue Bridge south side intersection with the dike.

(6)    East Apple Avenue at the intersection with the dike.

(7)    South end of North Kenwood Street at the intersection with the dike.

(8)    East Fifth Avenue at the intersection with the dike.

(9)    East end of the Central Avenue Bridge south side intersection of Asotin Street and Omak Avenue.

(10)    East end of Central Avenue Bridge north side forty feet east to the intersection with the dike.

(11)    Northwest corner of Stampede Arena thirty feet west of Gates M through S and the intersection with the dike.

(12)    Northeast driveway of the RV park at the intersection with the dike.

(13)    Sixty feet north of the intersection of east Third Avenue and the dike or Asotin Street.

12.22.015 Violation is a civil infraction.

Any person so operating a vehicle, or pedestrians or anyone allowing horses or other animals on the dike, or to use the dike in violation of this chapter is guilty of a civil infraction. (Ord. 1172 § 3, 1991: Ord. 811 § 2, 1979).

12.22.020 Penalty for violation.

Failure to perform any act required, or the performance of any act prohibited, by this chapter is designated as a civil infraction and shall not be classified as a criminal offense. Any person, firm or corporation found to have committed such a civil infraction shall be subject to the penalties as set forth in Chapter 1.16.
