ALCOHOL CONTROL

8.09.010 Prohibition.

(a)    The possession of alcoholic beverages in certain areas of city owned or controlled property and the consumption of alcoholic beverages in certain situations within the city is not compatible with the health and safety of persons using those areas or being present in those situations.

(b)    It shall be unlawful to possess alcoholic beverages in any city park, building, or public works enclosed structure.

(c)    Except as permitted by RCW Title 66, it shall be unlawful for any person to open the package containing liquor or to consume liquor in a public place.

(d)    Any police officer having probable cause to issue an infraction for a violation of this section shall have the power to immediately seize any alcoholic beverages possessed or being consumed in violation of this section. (Ord. 1292 § 1 (part), 2009).

8.09.020 Seizure, forfeiture and disposal of confiscated alcohol.

Any alcoholic beverages seized as provided in Section 8.09.010 shall be deemed forfeited from the owner’s possession and shall be disposed of pursuant to the policies of the police department. (Ord. 1292 § 1 (part), 2009).

8.09.030 Penalties.

Every person violating this chapter shall be deemed to have committed an infraction subject to a C-8 penalty. (Ord. 1292 § 1 (part), 2009).
