6.16.010 Keeping of certain fowl and poultry prohibited.

It shall be unlawful for any person for any reason to keep or harbor within the corporate limits of the city of Palouse any roosters, turkeys, geese, ducks, peacocks, pigeons, birds of prey, or game birds. [Ord. 928 §1, 2014; 1919 Comp. §155].

6.16.020 Chickens – Maximum number.

No person shall keep or harbor more than 20 chickens at any given time within the city of Palouse except upon approval of the city council. Any person desiring to keep more than 20 chickens may petition the city council for approval to keep additional chickens. If the city council determines that the additional chickens will not constitute a nuisance, the city council may approve the petition subject to such restrictions as it may determine reasonable and appropriate. If the city council subsequently determines that the additional chickens constitute a nuisance, it may withdraw approval for the additional chickens. [Ord. 928 §2, 2014].

6.16.030 Chickens – Running at large prohibited.

It shall be unlawful for any person to keep or harbor within the corporate limits of the city of Palouse any chickens unless the same are at all times kept in suitable enclosure meeting at least the following minimum requirements:

A. A minimum of 10 square feet per chicken within the enclosure;

B. The enclosure must comply with all applicable setback requirements for the particular use zone in which it is located;

C. The enclosure must be predator-proof on all sides and top; and

D. The enclosure must provide reasonable shelter from the elements. [Ord. 928 §3, 2014].

6.16.040 Chickens – Care and treatment.

No owner or keeper of chickens kept within the corporate limits of the city of Palouse shall cause or allow any of them to be or become malnourished, or subject to abuse or neglect. [Ord. 928 §4, 2014].

6.16.050 Violations.

Any person convicted of violating any provisions of this chapter shall be subject to a fine of not less than $25.00, nor more than $500.00 per violation. No part of the fine shall be suspended or deferred in any manner. [Ord. 928 §5, 2014].
