ABANDONED EQUIPMENT

8.20.010 Abandoning, discarding refrigeration equipment.

It is unlawful for any person to discard, abandon or leave in any place accessible to children any refrigerator, ice box, or deep freeze locker having a capacity of one and one-half cubic feet or more, which is no longer in use, and which has not had the door removed or a portion of the latch mechanism removed to prevent latching or locking of the door. 8.20.020 Permitting unused equipment to remain on premises.

It is unlawful for any owner, lessee, or manager to knowingly permit an unused refrigerator, ice box or deep freeze locker described in PMC 8.20.010 to remain on the premises under his or her control without having the door thereof removed or a portion of the latch mechanism thereof removed to prevent latching or locking of the door. 8.20.030 Keeping or storing equipment for sale.

Any person who keeps or stores refrigerators, ice boxes or deep freeze lockers for the purpose of selling or offering them for sale shall not be guilty of a violation of this chapter if such person takes reasonable precautions to effectively secure the door of any refrigerator, ice box, or deep freeze locker held for purpose of sale so as to prevent the entrance of children small enough to fit into such articles. 8.20.040 Penalty.

Any person committing any act prohibited by this chapter shall, upon conviction thereof, be guilty of a civil infraction and shall be punished by a fine of $25.00 for the first offense, the fine imposed for each such subsequent infraction shall be double the previous fine (e.g., second infraction $50.00, third infraction $100.00, etc.) up to a maximum of $500.00.
