10.14.010 Purpose.

The purpose of this chapter is to establish a residential parking permit system to facilitate residents and their guests parking in established parking permit areas, and to further authorize the city to issue parking permits as specified in this chapter.

10.14.020 Definitions.

For the purposes of this chapter, the following definitions are hereby adopted:

“Residential parking permit” means a parking permit validated and issued by the city allowing a resident or guest to park within a residential parking permit area, with privileges as specified in this chapter.

“Residential parking permit areas” means within the areas described in Section 10.14.030.

“Residential vehicle” means a licensed car, pickup truck, or similar vehicle parked in a residential area which is owned or leased by a resident of that residential area. The term shall not include commercial vehicles, buses, tractors, boats, trailers, recreational vehicles, or off-road vehicles, unless such off-road vehicles are licensed by the state of Washington for travel on public highways.

10.14.030 Residential parking permit areas.

The city council hereby designates the residential parking permit areas as those streets listed as follows:

A.    Posted zone on north side and east end of Commercial Avenue.

B.    Posted zone on north side of Warren Avenue between North Street and Chris Street.

10.14.040 Residential parking permits.

A.    Issuance of Permits. The city shall issue residential parking permits in accordance with the following guidelines:

1.    Application for a residential parking permit is required. Each permit is for one residential vehicle. The application shall include the following: name of resident, address of resident, phone number of resident, vehicle make, model, year and license plate number.

2.    Eligible recipients for a residential parking permit shall be persons residing within one block of the residential parking permit areas designated in Section 10.14.030.

3.    There shall be an administrative fee for each residential parking permit and a replacement residential parking permit. The fee shall be set by resolution and adopted by the city council. Such fee may be amended from time to time by resolution of the city council.

4.    The residential parking permit shall be valid as long as the same owner retains ownership of that residential vehicle for which the residential parking permit was issued, and that owner resides in the eligible residential area. Residential parking permits are renewable in two-year intervals expiring on the last day of the issuance calendar month. The residential parking program is limited to residential vehicles. The residential vehicles shall be licensed for the current year and operable.

5.    Residential parking permits allow the owner of the residential vehicle to park within the residential parking permit area. Residential parking permits do not guarantee or reserve a certain parking space.

6.    Residential parking permits are issued to a specific license plate number and are not transferable between vehicles or residents. Upon purchase of a new residential vehicle or change of license plates on an existing residential vehicle, the resident may bring in the resident vehicle registration and obtain a new residential parking permit. A replacement fee will apply as established by resolution of the city council. Such fee may be amended by resolution of the city council.

7.    Residential parking permits are to be affixed to the exterior of the back window on the lower part of the window on the driver’s side of the residential vehicle. Residential parking permits must be visible to approaching city parking enforcement personnel.

8.    Change of address is required. If a resident moves outside of the eligible residential area, the residential parking permit is no longer valid. There will be no fee for updating a residential address change within the eligible residential area.

9.    Lost or stolen residential parking permits will be reissued at the replacement fee. It is the responsibility of the resident to care for and control the use of the issued residential parking permits.

B.    The city shall determine eligibility for residential parking permits. Eligibility is established by a person or persons residing in the eligible residential areas complying with the following:

1.    Provide proof that person owns or leases the residential vehicle by the means of a current vehicle registration and valid state/government picture ID, or the residential vehicle’s registered address is the address of the permittee;

2.    Provide proof that person resides in an eligible residential area by the means of a property deed, rental agreement, current utility bill, or any piece of mail in the resident’s name; and

3.    The maximum number of residential parking permits are limited to no more than two per residential address. A third residential parking permit may be approved upon request of the resident and by approval of the city council.

10.14.045 Residential parking permits for guests.*

The city is authorized to issue residential parking permits for residential vehicles of guests of persons residing in an eligible residential area. The residential vehicle must be owned or leased by the guest and licensed in the current year and operable. Residential parking permits for guests shall not be issued for commercial vehicles, buses, tractors, boats, trailers, recreational vehicles or off-road vehicles, unless such off-road vehicle is licensed by the state of Washington for operation on public highways. This residential parking permit for guests shall be valid for a period of one to fourteen (14) days, and shall be clearly marked as to the period of validity. A maximum of twelve (12) residential parking permits may be issued to a guest in a calendar year. There shall be an administrative fee for each residential parking permit issued to a guest of a resident. Such fee shall be set by resolution and adopted by the city council. Such fee may be amended by resolution of the city council.

10.14.050 Permit parking privileges.

A.    A residential vehicle in which is displayed a valid residential parking permit as provided for herein shall be permitted to be parked in the residential parking permit area for which the residential parking permit has been issued and not subject to any posted time restrictions. Such residential vehicle shall not be exempt to parking restrictions or prohibitions established pursuant to authority other than this chapter. All other motor vehicles parked within a residential permit parking area shall be subject to the posted time restrictions.

B.    A residential parking permit shall not guarantee or reserve to the holder thereof a parking space within the designated residential permit parking area.

10.14.060 Permit—Revocation.

A.    The city is authorized to revoke any residential parking permit issued when one or more of the following circumstances has occurred:

1.    There is false information provided in the residential parking permit application; and/or

2.    Eligibility criteria, such as residential vehicle license, operability, ownership or residence is no longer met.

B.    To revoke the residential parking permit, the city shall send by first class mail a notice to the residential parking permit holder stating that the residential parking permit has been revoked and the reason or reasons why the permit is revoked, along with the appeal process as outlined in subsection C of this section. The effective date of the revocation shall be ten (10) calendar days after the date of mailing.

C.    The residential parking permit holder or an agent of the residential parking permit holder may appeal the city’s action to the city council by submitting a written appeal to the city clerk within five business days of the effective date of the revocation. The revocation shall be stayed pending the appeal. The appeal shall state the factual case basis with the residential parking permit holder’s claim that revocation was improper. Such appeal shall be deemed to be a Type 1 permit with the city council (open record) being the appeal body. Residential parking permits issued to a guest of eligible residents may be revoked immediately upon notice to the holder without right of appeal.

D.    Upon revocation of the residential parking permit, the person shall immediately remove such residential parking permit from the residential vehicle.

10.14.080 Violation—Penalty.

It shall be a violation for any person to have violated the requirements of this chapter or the following:

A.    To falsely represent themselves as eligible for a residential parking permit or to furnish false information in an application therefor to the office of the city clerk of the city;

B.    For a person holding a valid residential parking permit issued hereto to allow the use or display of such residential parking permit on a vehicle other than that for which the residential parking permit is issued, and such conduct shall constitute a violation of this chapter both by the person holding the valid residential parking permit and the person who so uses or knowingly displays a residential parking permit on the motor vehicle other than that for which it was issued;

C.    To produce or otherwise bring into existence any facsimile or counterfeit residential parking permit, or to knowingly use or display a facsimile or counterfeit residential parking permit in order to evade time limitations on parking applicable to the residential parking permit areas.

Any such violation shall constitute a class 2 civil infraction and shall be enforced under Chapter 7.80 RCW, as amended.
