9.92.010 Illegal usage.

It shall be illegal for any person, firm, association, corporation, or other such entity to use irrigation water for irrigation or any other nonessential outdoor use except as herein permitted. (Ord. 2240 § 1 (part), 2001).

9.92.020 Definitions.

The following words and terms for purposes of this chapter shall be defined as follows:

“Irrigation” is defined as any outdoor watering of lawns, gardens, bushes, flowers, and other vegetation.

“Irrigation water” when used together shall mean water supplied to home owners for irrigation purposes and which water does not pass through the user’s city water meter.

“Nonessential outdoor use” is defined as the outdoor use of irrigation water on vehicles, windows, driveways, sidewalks, buildings or other property when not necessary to prevent the destruction of such property. (Ord. 2240 § 1 (part), 2001).

9.92.030 Permitted use.

A.    The owner or occupant of a residence which has a street address or rural route box number ending in an even number may use irrigation water for irrigation purposes at such residence only on even-numbered days.

B.    The owner or occupant of a business which has a street address or rural route box number ending in an even number may use irrigation water for irrigation purposes at such business only on even-numbered days.

C.    The owner or occupant of a mobile home located in a mobile home park which has a lot number ending in an even number may use irrigation water for irrigation purposes at such mobile home lot only on even-numbered days.

D.    The owner or occupant of a residence which has a street address or rural route box number ending in an odd number may use irrigation water for irrigation purposes at such residence only on odd-numbered days.

E.    The owner or occupant of a business which has a street or rural route box number ending in an odd number may use irrigation water for irrigation purposes at such business only on odd-numbered days.

F.    The owner or occupant of a mobile home located in a mobile home park which has a lot number ending in an odd number may use irrigation water for irrigation purposes at such mobile home lot only on odd-numbered days. (Ord. 2240 § 1 (part), 2001).

9.92.040 Violation—Penalty.

Any person, firm, association, corporation or other such entity who violates the provisions of this chapter, upon determination by the Benton County district court that such violation has been committed, shall be subject to a civil penalty in the amount of one hundred dollars for each violation.
