4.24.010 Purpose.

The purpose of this chapter is to clarify under tribal laws and rules that an affidavit may be substituted by a declaration. [Res. 071123 (11/07/23)]

4.24.020 Definition.

An affidavit is a sworn, written, statement of facts, made voluntarily, and confirmed by oath or affirmation of the party making it, taken before a person having authority to administer such oath or affirmation, such as a notary. [Res. 071123 (11/07/23)]

4.24.030 Rule.

A written affidavit may be substituted by a written declaration. A declaration is a statement of facts voluntarily made, confirmed by affirmation of the party making it, under penalty of perjury. The written declaration does not need to have declarant’s signature verified or taken before a notary. The declarant certifies, verifies, or states in writing under penalty of perjury that facts are true and correct to the best of his/her knowledge. The declarant may be subjected to perjury charges if he/she knowingly submits a false statement. The following format may be followed for declarations.
