Subchapter 1. Title and Purpose

15.20.010 Short title.

This chapter shall be known as, and be cited and referred to as, the “Puyallup Land Acquisition Program” in accordance with and exercising the authority of the sovereign rights as the aboriginal owners and guardians of their land and waters, as reaffirmed in the “Medicine Creek Treaty,” and the “Constitution and Bylaws” of the Puyallup Tribe of Indians as amended and approved by the Tribe and Assistant Secretary of the Interior. 15.20.020 Purpose.

To restore lands to the Puyallup Tribe of Indians Puyallup Tribal Reservation and to provide for the basic needs of its people in economic/community development endeavors while protecting cultural, environmental, and traditional resource values. To establish a land acquisition system to analyze land acquisition needs and opportunities through priority assessment based on Tribal long and short range planning goals. To ensure financial evaluation of potential Tribal land acquisitions and to provide the necessary resources for property management of acquired lands. Subchapter 2. Program Concept

15.20.030 Puyallup Land Acquisition Program.

The Puyallup Land Acquisition Program will function in accordance with the “Tribal Land Acquisition System” which will establish an administrative procedure for the review/approval of potential land acquisitions. The Land Acquisition Program will be assigned to the Director of the Tribe’s Planning and Community Development Division and the division will provide support staff and other necessary technical assistance to the “Puyallup Land Acquisition Review Committee.” To facilitate the Tribal Council’s quarterly review and approval process which is envisioned within the framework of the “Tribal Land Acquisition System,” the Tribal Council will establish and appoint technical/professional staff to serve on the “Puyallup Land Acquisition Review Committee.” [Res. 020499A (04/02/99); prior code § 15.02.01]

Subchapter 3. Puyallup Land Acquisition System

15.20.040 Puyallup Land Acquisition System.

The Puyallup Land Acquisition System will function on a quarterly basis following the cycle of the Tribal Fiscal Year. The Puyallup Land Acquisition System will provide three operating protocols: (a) needs and priority assessment, (b) quarterly review and recommendation, and (c) emergency review and recommendation.

(a)    Needs and Priority Assessment. Beginning in the third quarter of the Tribal Fiscal year the Director of the Planning and Community Development Division will conduct a community outreach for the purpose of obtaining information from the Tribal membership, Tribal programs and other appropriate entities regarding the Tribe’s needs for land acquisition. Information obtained during the annual outreach will be summarized and provided to the Tribal Council for its review/approval. In addition, the Director of the Planning and Community Development Division will prepare an annual capital and operating budget for the Land Acquisition Program which will include funds for proposed land acquisitions, property management, property maintenance as well as program reserves for long-range acquisitions. These annual budget proposals will be submitted to the Tribal Executive Officer for consideration prior to the fourth quarter of the Tribal Fiscal year.

(b)    Quarterly Review and Recommendation. The Director of the Planning and Community Development Division will submit, in accordance with adopted guidelines and specific deadlines, to the Puyallup Land Acquisition Review Committee (PLARC) for quarterly consideration and recommendations of proposed land acquisitions. The PLARC will, in accordance with established guidelines and processes, review each potential land acquisition in order to provide comments and recommendations for the Director of Planning and Community Development Division’s presentation to Tribal Council. The Tribal Council will then review all comments and recommendations prior to consideration and approval.

(c)    Emergency Review and Recommendation. The Director of the Planning and Community Development Division will establish a procedure for the consideration of emergency land acquisitions including the circumstances which will qualify a potential acquisition for handling under the emergency procedures. The Director of Planning and Community Development will provide the Directors or other designated representatives from the Legal Department, Environmental Department, Fisheries Department, Planning and Trust Services Departments an opportunity to review each potential emergency land acquisition in order to make a recommendation to the Director of Planning and Community Development for presentation to the Tribal Council. The Tribal Council will then review all comments and recommendations prior to consideration and approval. [Res. 020499A (04/02/99); prior code § 15.03]

Subchapter 4. Puyallup Land Acquisition Review Committee

15.20.050 Establishment – Membership.

The Puyallup Land Acquisition Review Committee shall be established by the Tribal Council and the Director of Planning and Community Development Division will serve as Chairperson of the Committee. The membership of the PLARC will include the Directors or other designated representatives from the following Tribal departments and/or entities:

(a)    Tribal Executive Officer.

(b)    Director of Tribal Legal Department.

(c)    Executive Director – Marine View Ventures.

(d)    Executive Director – Puyallup Housing Authority.

(e)    Executive Director – Tribal Services.

(f)    Director of Environmental Programs.

(g)    Director of Fisheries Programs.

(h)    Director of Planning and Community Development.

(i)    Manager of Trust Services Program.

(j)    Tribal Controller or other appropriate Financial Committee representative.

15.20.060 Guidelines and policies.

The Director of the Planning and Community Development Division will develop appropriate guidelines and other policies to be used in conducting the quarterly review of potential Tribal land acquisitions.

(a)    Guidelines and policies as developed by the Director of Planning and Community Development will be submitted to the Puyallup Land Acquisition Review Committee for preliminary review, comment and recommendation prior to final approval/adoption.

(b)    Notice of the preliminary guidelines and policies will be published in the Tribal Newspaper, for the information and benefit of the membership, prior to final approval/adoption.

(c)    The Director of Planning and Community Development will hold at least one public hearing with the membership for the purpose of receiving their input and comments regarding the proposed guidelines and policies to be used in Tribal land acquisitions.

(d)    After completion of the required notification and review process noted above the proposed guidelines and policies will be submitted to the Puyallup Tribal Council for final consideration. [Res. 020499A (04/02/99); prior code § 15.04.02]
