20.90.010 Applicability.

The Zoning Code and Official Zoning Map may from time to time be amended, supplemented, modified, or repealed in accordance with the following procedures provided that no change shall be approved that is inconsistent with the Quincy Comprehensive Plan and follows the requirements of the Growth Management Act Chapter 36.70A RCW. 20.90.020 Procedures.

A. Initiation: Amendments, supplementations, modifications, or repeals of or to the Zoning Code may be initiated by the following:

1. The City Council;

2. The Planning Commission;

3. Property owners by:

i. Filing with the City Clerk a petition signed by one or more property owners within the City setting forth the proposed change and t reasons therefore, and

ii. Payment of the applicable fee(s) prescribed in Section XIII of the ordinance to help defray the cost of processing the petition;

iii. The petition must be filed at least thirty days prior to the date of the Planning Commission hearing where the petitions will be considered. The Developer must demonstrate, and the Planning Commission and City Council must find the following with respect to a proposed change in the Use District of property:

(a) The change is consistent with the purposes of the Comprehensive Plan;

(b) The change is consistent with the purposes of the Zoning Code;

(c) The change is consistent and compatible with the uses and zoning of the surrounding property; and

(d) There have been significant changes in the circumstances of the property proposed to have its Use District changed, or the surrounding properties, to warrant a change in the Use District for the property.

B. Public Hearings Required: Prior to the adoption of any Proposed amendments, supplementations, modifications, or repeals of or to the Zoning Code a public hearing shall be held by the Planning Commission, pursuant to the requirements of the Development Code, who shall make recommendations to the City Council. 20.90.040 Use districts of annexations.

At the time of the official public hearing in any proposed annexation of property to the City, the City Council shall stipulate precisely the Use District classification or classifications of the area to be annexed as a part of the annexation ordinance and the Official Zoning Map shall be changed accordingly. The Use District classification or classifications applied to the newly annexed area or areas shall be consistent with and as shown on the Land Use Designations Map in the Quincy Comprehensive Plan.
