1.08.010 Purpose.

It is imperative that Rainier’s ordinances are properly enforced. To better accomplish this goal, the town has designated certain violations of its ordinances to be civil infractions pursuant to RCW 35.27.370. The purpose of this chapter is remedial. Use of the civil infraction procedure will better protect the public from the harmful effects of certain violations of the town ordinances, will aid and streamline enforcement, and will partially reimburse the town for the expenses of enforcement and the related judicial process. 1.08.020 Violation—Penalty.

A.    Any person violating any of the provisions or failing to comply with any of the mandatory requirements of the ordinances of the town shall be guilty of a civil infraction unless the violation is made a misdemeanor by ordinance or required by state law to be a misdemeanor.

B.    Except in cases where a different punishment is prescribed by any ordinance of the town or otherwise required by statute, any person convicted of a misdemeanor for violation of an ordinance of the town is punishable by a fine of not more than one thousand dollars ($1,000.00), or by imprisonment not to exceed ninety (90) days, or by both such fine and imprisonment.

C.    Except in cases where a different punishment is prescribed by any ordinance of the city, or otherwise required by statute, any person convicted of a civil infraction of an ordinance of the city is punishable by a civil penalty of not more than five hundred dollars ($500.00).

D.    Each such person shall be guilty of a separate offense for each and every day during any portion of which the violation is committed, continued or permitted by any such person, and shall be punishable accordingly. (Ord. 468 § 1, 2002; Ord. 370 § 1, 1996)
