8.04.010 Title.

This chapter shall be know and may be cited as the “Town of Rainier E-911 Ordinance.” (Ord. 320 § 1, 1992)

8.04.020 Declaration of policy and intent.

A.    It is declared to be the policy of the town, in the exercise of its police powers for the protection of the public health, safety and general welfare, that all of the citizens of the town have a telephone system which allows their PBX system to properly interface with the E-911 system and that these systems provide both automatic caller identification and selective routing to the appropriate public safety answering point. It is the intent of the town, in the implementation of this chapter, that all telephone systems provide service that will interface with the E-911 system to provide these benefits to all citizens.

B.    It is further declared that the availability of such products or services is critical to the health, safety and welfare of the general public, and is also necessary to provide an effective means for Rainier fire, medical and police units to efficiently locate and promptly respond to any emergency.

C.    The express purpose of this chapter is to provide for and promote the health, safety and welfare to the general public and not to protect individuals or create or otherwise establish or designate any particular class or group of people who will or should be especially protected or benefitted by the terms of this chapter. The obligation of complying with the requirements of this chapter and the liability for failing to do so is hereby placed upon the owners or persons responsible for the conditions of the buildings or premises. 8.04.030 Scope.

This chapter shall apply to all building, appurtenant structures and premised located in the town, including (1) those structures within which PBX systems are presently installed or used, (2) those structures hereinafter constructed in which telephone systems are installed or used, and (3) those structures which are hereafter altered, rehabilitated or repaired in which telephone systems are installed or used. (Ord. 320 § 4, 1992)

8.04.040 Definitions.

For the purposes of this chapter, certain words, terms, phrases and the derivations shall be construed as specified in this section. “Access address” means the residential living unit, or for commercial buildings, the street address, floor number (for buildings over two stories), and the access point for secured facilities.

“ALI” means automatic location identification, as provided by the E-911 system, including but not limited to the caller’s telephone number, the class of phone service (residence, business, coin, PBX, etc.), the date and time of call, the caller’s name, address and town, the routing code of the call, the pilot number, and the port or trunk on which the call is received. It also includes the name of the PSAP and the agencies that are responsible for police, fire or medical response to that address.

“ANI” means the unique dialable number identified with the calling party’s phone or call-back phone number associated with the location of telephone in commercial structures.

“Call-back phone number” means a telephone number that can be called from the public switched telephone network which a PSAP can call to confirm the nature of a call made to 911 which may have been disconnected.

“Central office software based telephone system” means a telephone switching system provided through the facilities at a telephone company central office that provides functions similar to a PBX telephone system.

“E-911 telephone system” means a public telephone system consisting of a network, data base, and on-premises equipment that is accessed by dialing 911 and that enables reporting police, fire, medical or other emergency situations to a public safety answering point. The system includes the capability of selectively route incoming 911 calls to the appropriate public safety answering point that operates in a defined 911 service area and the capability to automatically display the name, address and telephone number of incoming911 calls at the appropriate public safety answering point.

“Private branch exchange system (PBX)” means a private telephone switching system connected to a common group of lines. “Selective routing” means the function of the 911 telephone system which directs the call to the proper PSAP, based upon the calling party’s address. (Ord. 320 § 3, 1992)

8.04.050 Specific location and phone number information required.

A.    Owners and lessees of PBX systems shall configure their telephone systems so that access address location and call-back phone number information will be provided for each PBX station line that has local access to the Thurston County E-911 system. In this way every building, appurtenant structure or premise within the town of Rainier, where a telephone system is presently installed or which will be hereafter installed shall have telephone services which will properly interface with the E-911 system by making the following ANIALI information available to the PSAP when any party within the system calls 9-1-1:

1.    Name;

2.    Access address to which emergency aid must respond;

3.    Telephone number to which a return call can be made;

4.    City.

B.    The provisions of this chapter shall apply to all new buildings, appurtenant structures and premises and to all such structures hereafter altered, rehabilitated or repaired. All building permits obtained after January 1, 1993, shall require certification that the telephone system interfaces to E-911 to provide

ANI-ALI information adequate for emergency response. This must be demonstrated before a certificate of occupancy is granted.

C.    All existing buildings, appurtenant structures and premises with PBX systems presently installed shall require certification that the telephone system interfaces to E-911 to provide ANI-ALI information adequate for emergency response by January 1, 1997.

D.    Owners and operators of PBX systems shall provide record updates to the E-911 data base within ten (10) days of any activity which affects the accuracy of the data. (Ord. 434 § 1, 2000: Ord. 419 § 1, 1999: Ord. 320 § 5, 1992)

8.04.060 Enforcement.

A.    The provisions of this chapter and any rules and regulations promulgated thereunder shall be enforced by the town in accordance with the enforcement and penalty provisions of this code.

B.    The town is authorized to adopt rules and regulations that are necessary to implement the requirements of this chapter and to carry out the duties hereunder. (Ord. 320 § 6, 1992)

8.04.070 Fees.

A.    No fees shall be charged for inspection of buildings, appurtenant structures or premises for compliance with this chapter, if such inspection is carried out in conjunction with any required inspection under the Uniform Building and Fire Codes.

B.    Fees may be charged for inspection systems in structures that were constructed prior to the enactment of this chapter. (Ord. 320 § 7, 1992)

8.04.080 Liability.

Nothing contained in this chapter is intended to be nor shall be construed to create or form the basis for any liability on the part of the town, or its officers, employees or agents, for any injury or damage resulting from the failure of a PBX owner or lessee to comply with the provisions of this chapter, or by reason or in consequence of any inspection, notice, order certificate, permission or approval authorized or issued or done in connection with the implementation or enforcement of this chapter, or by reason of any action or inaction on the part of the town related in any manner to the enforcement of this chapter by its officers, employees or agents.
