8.24.010 Sale and discharge—Consumer fireworks.

A.    Only consumer fireworks as defined in Chapter 70.77 RCW are legal for sale to the public from twelve noon to eleven p.m. on June 28th, from nine a.m. to eleven p.m. on each day from June 29th through July 4th, and Thursday through Sunday the fourth weekend in August, from nine a.m. to nine p.m. on July 5th, from twelve noon to eleven p.m. on each day from December 27th through December 31st of each year, and as provided in RCW 70.77.311.

B.    Consumer fireworks may be used or discharged each day between the hours of twelve noon and eleven p.m. on June 28th, between the hours of nine a.m. and eleven p.m. on June 29th to July 3rd, Thursday through Sunday the fourth weekend in August, and on July 4th between the hours of nine a.m. and twelve midnight, and between the hours of nine a.m. and eleven p.m. on July 5th, and from six p.m. on December 31st until one a.m. on January 1st of the subsequent year, and as provided in RCW 70.77.311. 8.24.020 Permit—Sale of consumer fireworks.

A.    A permit for the retail sale of consumer fireworks issued by the city treasurer must be prominently displayed at the sales location.

B.    Retail operators applying for a permit shall submit a copy of their state retailer license authorizing the holder to sell consumer fireworks under this chapter. Each permit application must be made to the fire chief in compliance with Chapter 70.77 RCW.

C.    The annual permit fee for the retail sale of consumer fireworks shall be per chapter as authorized by the laws of the state of Washington, payable in advance to the office of the city treasurer at Rainier City Hall.

D.    Only one permit per year for the retail sale of fireworks shall be issued to any person and that permit shall entitle the permittee to maintain one retail outlet only. (Ord. 630 § 1 (part), 2015: Ord. 325 § 1 (D—G), 1993)

8.24.030 Permit—Display fireworks.

The city council may authorize the city clerk to issue permits for display fireworks in accord with Chapter 70.77 RCW and other relevant laws for New Year’s, Independence Day, Round-Up Days and other appropriate occasions upon recommendation of the fire chief. (Ord. 630 § 1 (part), 2015)

8.24.040 Emergencies—Restrictions on use.

The mayor, after consulting with the fire chief and other officials as may be appropriate, may prohibit the discharge of all fireworks during periods of extreme fire danger. The term “extreme fire danger” means a period that wildland fires can be expected and fire growth will be accelerated. Notice of any prohibition ordered by the mayor must be conspicuously posted throughout the city. (Ord. 700 § 1, 2021)
