11.08.010 State speed laws applicable.

The state traffic laws regulating the speed of vehicles shall be applicable upon all streets within this city, except as this code, as authorized by state law, declares and determines upon the basis of engineering and traffic investigation that certain speed regulations shall be applicable upon specified streets or in certain areas, in which event it is unlawful for any person to drive a vehicle at a speed in excess of any speed so declared in this code when signs are in place giving notice thereof. 11.08.020 Increasing speed limit in certain zones.

It is determined upon the basis of an engineering and traffic investigation that the speed permitted by state law upon the following streets and segments thereof is less than is reasonable and safe under the conditions found by such investigation to exist upon such streets; and except when signs are posted pursuant to state law setting a different maximum speed, the maximum speed permitted on such streets shall be as set forth in this section at the times specified when signs are erected giving notice thereof, but in no case shall the speed limit exceed 60 miles per hour:

11.08.030 Decrease of state law maximum speed.

It is determined upon the basis of an engineering and traffic investigation that the speed permitted by state law upon the following streets is greater than is reasonable or safe under the conditions found to exist upon such streets. The speed limit shall be as set forth in this section on those streets or parts of streets designated in this section at the times specified when signs are erected giving notice thereof.

11.08.040 Regulation of speed by traffic signals.

The traffic engineer is authorized to regulate the timing of traffic signals so as to permit the movement of traffic in an orderly and safe manner. [Ord. 413; Ord. 05-03; Ord. 2023-10 § 1].

11.08.050 Decrease of posted speed in construction zones.

A. Authority. The public works director shall have the authority to order placement of a reduced speed limit to regulate speeds in construction zones on city roadways as part of an approved traffic control plan. A roadway construction zone is an area where construction, repair, or maintenance work is being conducted by public employees or private contractors, on or adjacent to any public roadway. In no case shall the reduced speed limit be less than that authorized under RCW 46.61.415.

B. Regulation. No person may drive a vehicle in a roadway construction zone at a speed greater than the posted speed limit when signs are erected giving notice thereof.

C. Penalty. A person found to have committed any infraction relating to speed restrictions in a roadway construction zone shall be assessed a monetary penalty equal to twice the penalty assessed under RCW 46.63.110. This penalty may not be waived, reduced or suspended. A person who drives a vehicle in a roadway construction zone in such a manner as to endanger or be likely to endanger any persons or property, who removes, evades or intentionally strikes a traffic safety or control device is guilty of reckless endangerment of roadway workers. A violation of this section is a gross misdemeanor punishable under Chapter 9A.20 RCW and includes both monetary penalties and the suspension of license or permit to drive or a nonresident driving privilege, for up to 60 days, of a person convicted of reckless endangerment of roadway workers.
